  • Apologies if this post shows up twice...haven't quite got the hang of this yet. Recently, I checked our current account which my husband has been solely managing the last few years (and not very well I hasten to add). On checking a few statements I noticed we had some very steep charges so last month I wrote to Barclays requesting 6 years back statements, which they sent very quickly, and free of charge (very generous of them!). After wading through these we calculated they had levied just over £1,000 in paid referral charges against our account. We have been loyal customers of Barclays for over 30 years (not that it counts for much) and I have now paid up the overdraft and our account is well in the black, although I had to plunder some hard earned savings to do this. On the 2nd December I wrote to them requesting a refund and received a reply today the 8th December offering us £403.00 as a 'goodwill gesture'. I feel this is not enough and intend to ask for more. If Barclays refuse can they also withdraw their original offer of £403.00.?

Oh I think I have it - I look out for Paid Referral right?

Try looking for the @ symbol in the Barclays statements, these tend to be in the debits you are looking for.

What's the best format for the charges? Handwritten list along with a copy of the original statements (highlighted) or should I plug the data into Excel?

Excel is a lot clearer and allows you to manipulate the data yourself later e.g. when adding judicial interest

Just wondering did you send the SAR letter recorded or not? I sent mine first class only and am now wondering about its validity should the bank deny receiving it.

It will be valid but perhaps if you could try dropping the letters in at your local branch it will calm your worries. You get a receipt for yourself and are certain it got delivered. If their internal mail delivery system doesn't work, it's their fault.

They can withdraw the offer at any time and will do so later when you show the resolve to take them as far as necessary to regain your money. If you stick at it and prepare yourself, you will get all your money back.

You only mention Paid Refferal fees, have you not had any 'Unpaids Out' or 'Card Misuse' charges? Don't worry if you go back and check and find you have more charges than you thought, you can put the modified figure in your LBA.

    Best of luck.
  • Barclays have charged me £1,540 in the last 6years. I sent my letter off wed (6th dec) requesting my money back... just wondering how long do they take to reply? They were very quick sending me my statements took just over a week.

Good luck - I asked for my statements ( 2 accounts) earlier this week and am looking forward to totting them up, could we compare notes as we are doing it at approx same time - will be interesting.
  • Barclaycard has offered me a partial refund and has quoted the OFT's ruling. Do I pursue this further or do I just accept the offer they have made? Has anyone had success in having all of their charges refunded and if so, at what stage?

Send the first letter in Martins article. This is a Subject Access Request letter under the Data Protection Act. The maximum they can charge by law for this is £10 for the information you are requesting.

Jennifer, it is up to you if you take it further or not. If you do take it further, they will pay up eventually, it might take a bit of time and the filing of court papers... up to you if its worth the hassle or not, but I know what I'd do... ;)

JD, send the template subject access request letter to the northampton address by recorded delivery and don't bother dealing with them by phone. They'll give you all sorts of, ahem, rubbish to try and wriggle their way out of complying but they've just had an, ahem, ticking off from the information commissioner, so they'll comply in the end.

KEEP PUSHING and you will get all of your money back!

In all honesty, there is no standard length of time you will wait for a reply. Some people quickly get a partial offer, some get a form letter saying they'll look into it but need more time (yeah, right) and some don't hear a peep.

Unless you settle for a partial offer, barclays will make you go the full distance and settle the day before the case is heard. So in that sense of 'how long it will take', months is about right.
  • I have just received all my statements from Barclays and I am ready to make a claim...

I am still using my Barclays account but I have set up a new Bank Account with SMILE ready to switch to as soon as I receive some (or all) charges back from Barclays. I don't want to be with them anymore anyway. Plus, the interest is so much higher with Smile and the charges are much fairer than Barclays. I didn't have to put any money in to open the new Smile account so it's just sat there ready and waiting.

Could someone please tell me where I now send the letter reclaiming charges along with copies of my statements highlighting all charges? I assume it's not the same address as where I wrote to ask for the 6 years statements is it? Thanks so much. Dont want to mess up!!
