    Got a letter not from my branch but from Customer Services. (I first wrote to my branch on March 5th and have had no reply at all!).
    "I am sorry you are unhappy with the charges you have incurred. Your comments are receiving attention and one of my team will contact you as soon as possible.
    May I take this opportunity to explain that whilst we will endeavour to respond to you within timescale outlines in your letter, we cannot guarantee that we will so so. Sometimes it does take longer to fully investigate a complaing. However, we do aim to find a solution within four weeks. If we are not able to do so, we will always write to you explaining what is happening. A full report or an update on our progress will be sent to you within eight weeks".
    In my second letter to my branch I threatened court. Is it now time to do it? For them to be setting the timescale just seems wrong and .... rather fishy!


    My opinion is divided on this one... I stuck rigidly to the timescales outlined on this site and got little joy whatsoever (a paltry offer of less than half), so had to take the bank to court.

    My boyfriend's two brothers allowed the bank (same bank as me - Barclays) to have their 8 weeks to investigate and both of them had brilliant offers which were settled and paid in recently. My mother recently claimed and also allowed the bank their 8 weeks. She got a great offer which she accepted.

    Whichever way you decide to go, bear in mind going down the court route could possibly take 8 weeks or longer (I sent my first letter at the beginning of February and it's now the 10th of May!) so it's really up to you to decide whether you will allow the banks 8 weeks to look into your case or whether you want to try and force them into a quicker decision by taking them to court. From what I gather, from personal experience and reading this site's forum, sometimes it makes the bank act faster and sometimes it doesn't.

    I claimed back charges from Barclays and I was initially sent a letter stating they would deal with complaint within 4 weeks and 4 weeks to the day exactly they sent me a letter offering 75% of charges. I was going to push for more but was desperate for the the money so accepted. Barclays don't seem to use the same approach with every case. I suppose it might depend on how much you are claiming back.

    Right... to cut a long story short- Ended up filing a claim against Barclays as the amount they offered me was pityful, considering the amount they owed me. I filed a claim about 3 weeks ago and today ive received a letter saying Barclays is going to defend itself against my claim. Now, i have read on this site that thats not much to worry about and that its doubtful they go through with it, and should settle probably just before the hearing date.

    Now im hoping someone else (hopefully regarding Barclays) has also had their claim go this far. Any advice is appreciated and what the outcome of your claim was?

  • The banks are leaving it to the last minute to pull out because they're hoping the thought of court and them defending themselves will scare you into settling, I too have just had a letter saying theyre going to defend themselves (see "my bank defends!" thread). Im hoping that is the case though, as like my thread says they're letting it go to court.

    Hi, Im Really New To This So Not Quite Sure If Im Doing Things Right, But Im Trying To Reclaim Bank Charges For My Partner On His Barclays Account! Ive Sent First Letter Requesting Statements Etc And They Replied Saying They Would Collate This Info For Me Etc And That They Will Be With Me In The 40 Day Timescale, But From What I Worked Out They Should Have Arrived Tuesday But Havent, But Reading A Few Posts Im Not Sure If Im Ment To Be Going By A 40 working Day timescale?? As If This Is The Case Then I May Have To Wait An Extra Couple Of Weeks, Please Could Someone Let Me Know If This Is A 40 Working Day Timescale Or Not As Dont Want To Cause A Fuss With The Bank If It Is Me Who Is Incorrect! Any Help Would Be Much Appreciated! Thanks In Advance! Sorry For The Text Hit The Caps By Mistake.
  • It took me more than 50 days to get my statements. They only sent them because I threatened to report them for a breach. I would write back - they got them to me within days of the second letter.

    Im posting this on behalf of my aunt who is need of some urgent advice and im hoping you lovely people can help me :D

    She is claiming on a closed account and woolich/barcleys had there 8 weeks and this week was week 10 and she receives a letter through the post stating they have looked at her case in detail and have decided they will not be refunding any of teh charges!! I though they at least had to refund something! She is claiming just over £600. She has no outstanding debts or loans with them. She is in cocntact eith the FO but would like some advice tonight on whether this is final or do they have to refund and is this a tactic?

  • :confused::confused: Help I have made an mcol claim, and have just noticed that I should have calculated interest for each separate charge yearly. I did not do this but just put an 8% charge on top of what they owed me. I did say in my particualrs of claim that I have done this. Will I be in trouble
  • Sent my first letter on 29 March together with £10 cheque.
    Haven't received anything, cheque not cashed, so I phoned them tonight only to be told that they would reply within "40 calender working days" (their phrase not mine)!!
    When I asked if they could check my request had been received, I was told to go into my branch tomorrow where they could check this as the phone operator didn't have access to this info on his screen.
    My question is - are they allowed 40 working days to reply, or 40 calender days (which has now expired). I would like to be armed with this info before going into my bank.[/QUOTE][/QUOTE]
