I have issued a MCOL with Barclays and I thought I would email the litigation dept to see if they wanted to settle out of court (could really do with the money right now!) and I got this reply from them. Just thought I'd post it on the board so people can see what Barclays stance is on settling cases and the timescales involved...
Thank you for your email and your offer to settle early. I fully intend to settle your claim before it gets to court but the only problem is the sheer amount of people I am dealing with at the moment. I am still dealing with people who are in court next week, and unfortunately the first possible time I am able to look at settlement is once they have a court date set. I know this is not an ideal solution but unfortunately it is the only method we have of not missing anybody. I will of course refund any new court costs incurred in the eventual settlement.
Please feel free to contact me once you have a court date and I will be able to give you a better sense of when your case will be settled.

Wonder what the Courts' opinion of this would be?? They must already be fed up with the banks no-shows or last minute settlements. If the bank(s) have no intention of defending the case, why have they let it get as far as MCOL - why not just settle after the second letter? After all they then have to pay your costs as well. Why don't they just accept the situation and pay up!!0

I used the email address which was on my Acknowledgement of service form, sent by the court which was thomas.hickey@barclays.com
He answered within the hour, which impressed me mightily!
I basically said, we have an ongoing claim (I quoted the claim number) and said I would be happy to settle out of court for a slightly lesser amount for a speedy resolution.
Yes I absolutely agree that if banks have absolutely no intention of ever going to court, why not settle before we ever get to that stage? It must be driving the judges insane to have to file all the paperwork only to have all cases settled before he can even get his wig on. It must also be a huge burden on the small claims court and must be having a huge impact on other non-bank charges claims.

Hi, new to this just got my 6 years worth of statements yesterday. I am unsure what I can try and claim back and what I can't
Can anyone help me with these, I have an overdraft facility on my Barclays Additions account and have been charges loads of times a "paid referral" fee ranging from £20 to £35. Can I claim these back do you know?
Also what about interest charged every month, I suspect I couldnt get this back is it is overdraft interest?

Just a little confused. I'm just about to to fill in the Court Claim Form, but not sure what amount to put in the "Amount claimed" box. Is it the charges with or without interest. So far I've been asking for interest. Am I correct in thinking that I can only claim for the actual charges, and if the court judges against B***lays, then I can add the interest? Or do I claim the lot at the outset?
Fill in the amount to claim including the interest.
if you have stuck to the time table and sent all the letters then you have given them plenty of time to pay up so now its time to claim the lot. Barclays have been doing this for a long time now, they know the score.
Dont forget to recalculate the interest when they settle up, as this may be a couple of months away yet.:cool:Not just a white vanman:cool:

Good on ya. Just remember to be firm and most of all be confident, that money is YOURS and they know that. if you can keep your nerve and show them that you know what you are talking about and doing then you may just convince them that you mean business and get your money back sooner rether than later.

Well fnally got thro to someone, and they have insisted that they will not renegotiate the amount (£2370.00 from claim £3160.00) so if not happy with the amount ,then do what I feel I must. at the moment Im still stuck, will talk it thro with my family, and make a decision, afterall it is what I had already thought of as lost.

Got a letter not from my branch but from Customer Services. (I first wrote to my branch on March 5th and have had no reply at all!).
"I am sorry you are unhappy with the charges you have incurred. Your comments are receiving attention and one of my team will contact you as soon as possible.
May I take this opportunity to explain that whilst we will endeavour to respond to you within timescale outlines in your letter, we cannot guarantee that we will so so. Sometimes it does take longer to fully investigate a complaing. However, we do aim to find a solution within four weeks. If we are not able to do so, we will always write to you explaining what is happening. A full report or an update on our progress will be sent to you within eight weeks".
In my second letter to my branch I threatened court. Is it now time to do it? For them to be setting the timescale just seems wrong and .... rather fishy!0 -

They've had their letters, I got responses: Complaint received, etc, etc, we'll get back in a month. Another one: Still not resolved get back in another month… Finally an offer of £1,070, claiming £1,900. I haven't bothered even responding, going straight for the jugular, I've had enough. Also had my barclaycard limited reduced from £3,000 to £610 (but nothing to with reclaiming charges, apparently!)

Thats a shame, well it was worth a try. as for accepting the offer....well only you can answer that one and dont let ANYONE else on this site talk you into making a decision only you can do that so i hope you make the right one sue
