  • I am in the process of trying to reclaim my bank charges from Barclays and have not proceeded to the court stage however I have just received a letter from them stating that I knew what the bank charges were when I signed up to the account and therefore they would not refund my charges.

    Has anyone else received this or is this just to scare me off

    Yeah that's right - something i my papers said print it 3 times but the third is for yourself so you can insert your original documents (letters and bank statements) in there and make sure you keep that version.

    Keep us posted as to whether or not this prompts them to settle within a couple of weeks.

    It is a standard reponse. Yes, the charges are in the T&C's. So what?

    The legal situation is quite clear. The charges are "extravagantly" higher than the actual cost of adminstering the breach of contract and are therefore unlawful. A contract must be within the law and any unlawful terms and conditions in a contract are unenforcable.

    For example, you lend me some money and I promise to pay you back by a certain date. I don’t, so you ring me up to remind me. You could legally add the cost of the ‘phone call to my debt. What you cannot do is add an excessive amount to this as a penalty. Even if you told me you would do this if I didn’t pay you back in time when you lent me the money, this makes no difference. If someone tells you that they are going to punch you before doing so, it doesn’t make it legal.
    The acquisition of wealth is no longer the driving force in my life. :)

    How long did it take for you to get a court date after Barclays had acknowledged with MCOL?

    Once barclays have acknowledged the get until 28 days after the notice was SERVED (about 5 days after you raised it) to submit a defence - and they generally do it on the 28th day!! You'll be sent a copy of their defence and a letter advising which court (local to you) it has been transferred to. It took about 6 weeks after that for the court to contact me (that's once of the reasons my claim has taken so long) but it really depends how busy your local court is.

    I have had the same thing happen to me. I paid a chunk of my balance off and they reduced my credit limit and said I couldn't withdraw cash - I didn't do that anyway but it really annoyed me!

    I guess there is a connection there somewhere, but Barclaycard is next on my list for reclaiming!

    I am finding that since we put a claim for charges against barclays they are

    resulting to very underhand tactics.
    (1) canceling ur dd's and so's without notification
    (2) canceling our debit cards without notification
    (3) who knows whats next ?

    regarding no2 we went to do shoping yesterday as you do and i put my debit card into the ATM and low and be hold it took my card saying unautharised usage.
    After i picked myself up off the floor !!!!!! i went to my local branch and asked what the hell was going on they told me (quote) that are cards had been reported lost or stolen. my reply as you can gather was not prety
    Was told to ring debit card services to sort it out as they would not .

    HOW DIRTY AND UNDERHAND CAN THEY GET ,I DREAD TO THINK
    MY ADVICE TO ANY BODY IS GET ALL OFF YOUR MONEY BACK AND TELL BARCLAYS TO SHOVE THERE ACCT WHERE THE SUN DONT SHINE

    sory this is long winded but that mad had to tell anybody that is dealing with barclays as i feel it is only happening to me

    hi maid as from reading all the sucess stories no it wont go to court they will settle 1 or 2 days b4 it does

    Hi Guys & Gals!

    I'm a complete noobie, I'm about to send my letter (recorded delivery) to Barclays about claiming my charges back, i'm worried that they are gonna cancel direct debits/standing orders and reduce my "free" overdraft, is there anything i can do to try and stop this happening?

    Can anyone suggest a good parachute account (i'm not fussed if its with another bank or building society), also, how soon do you all suggest i set thsi new account up?
