    Just had a letter back offering me £1600 - no way am I accepting that, I am now replying saying no, and also filing on MCOL the same day!
    Do I do right? Claim is for £2450.63 (got more interest to add on once court application is made)

    You can reject that offer if you want, but if they full amount without the interest before you go to court you must take it or risk looking greedy to the judge, who might make you pay the courts costs, etc...

    I would be perfectly happy with that, I have a sneaky feeling that I will be one of the lucky ones who has to go to court.
    Just a quick question, should I write to them and say thanks but no thanks, then file my case to the courts? or do I not need to tell them?
    Or should I say thanks, but I am not excepting that, however I would except a higher amount blah blah blah.
    Or is it time to just go for the court action right away. I really do not know what to do for the best.

    flippin barclays drive me mad!!!

    1) they have sent me 3 set of identical statements
    2) had a letter stating they were looking into it and would reply by 30th April
    3) had a snotty letter saying give us back your bank card or we're sending people round to collect it
    4) I phoned and said do you want your card back because I'm reclaiming my bank charges? because it strikes me as a bit of a coincidence - response was no one gets their charges back... my response was oh don't they? suggest you check the MSE website - tone of conversation changes, very sorry to have bothered you and please ignore our letter.
    5) had another letter saying "we need a bit more time so we'll get back to you on 30th May.


    I very don't think so barclays......off to file MCOL claim!

    Hi

    Just a quick question, my MCOL claim was served to Barclays on 9th April and they acknowledged on 20th April - they now have until 7th May to defend the claim (28 days from 9th) which reading the threads they will do. The acknowledgment form has also been ticked next to the 'intend to defend all of this claim' section and has been signed by Adrian St John (Barclays solicitor).

    I assume I just keep an eye on the MCOL site and on 7th May start the next procedure (judgement?) or am I likely to hear from the courts before then advising that the claim is being defended?

    Any advice welcome at this stage!

    my online claim was issued on 2nd april and notice of acknoledgememt filed by barclays, pls does this mean i can ask for judgement tomorrow or is it tuesday?

    hi im trying to reclaim
    my bank charges from barclays,they sent me the old statements and i have worked out that i had 1340 in charges.So i phoned them up and they said they would take 20 working days to look into it so i said ok,i got two letters one saying i would hear no later than by the 28th april and another saying 5th of may.Now i phoned up on friday saying is there any progress being made and the guy said nothing has been noted as yet but we may ask to extend this if nothing has been sorted by then and he said my take up to 8 weeks (its been 5 already) but dont know whether to wait for the 5th and see what happens.what options do i have?can i write to them demanding money sooner because i have been chasing this since middle of jan

    Sorry if this has already been posted - there doesn't seem to be a way of searching this thread easily!! :confused:

    I reclaiming charges on behalf of my brother - we've got to the MCOL stage (they offered a partial settlement, which we don't want to accept, so haven't responded to.....)

    I understand it's five days to serve, then 14 days, then another 14 days if they acknowledge the claim (which it sounds like Barclays pretty much always do!! :mad: )

    We did the claim on the 10th of April, which means the deadline for no response from Barclays (i.e 5 + 14) should have been yesterday (i.e the 29th April).

    When I checked it this morning and clicked on "judgement / start", and then "judgement by default" (understand this is what you click if you have no response?!), it came up with the following message:
    You cannot request a Judgment by Default at this time.

    The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default.

    If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default.

    If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged.

    Does this mean Barclays have filed an acknowledgement? How would I know - we haven't received any paperwork from either Barclays or the courts, and nothing has changed on the MCOL site :(

    Can anyone help? What's the next step? :(

    It does sound like Barclays have acknowledged your claim which will then given them a further 14 days which means you can't file for judgement until 28 days from the date they were served.

    The MCOL site should say this if you view your claim (mine did)? Perhaps the site is running slowly now as I am sure they are inundated. You could check again tomorrow to see if it's changed? Otherwise it might be worth trying to find a contact number of perhaps MCOL or your local court to get some advice?

    Sorry but that's the best advice I can offer.

  • Soz guys my claim was acknowledged by Barclays on the 28th April is the 28 days from this date or from when the claim was issued on 16th April.
