    I have been reading back over posts and found some really helpful just had a few questions i hope someone can help me with please.
    I am at the early stages of claiming back my charges from Barclays (sent letter requesting statements in March and received my cheque back with the DPA letter that many of you seem to have had on 30th March so 40 days is up in 4 days)
    What I am wondering about is:
    1. My account never had an authorised overdraft limit so each of my charges was for unauthorised overdraft which I believe is in terms and conditions will I still be able to claim?
    2. If the answer to the above is yes I am still a little confused as my bank seems to be charging me twice once as a PAID REFERRAL and then again as a COMMISION can i claim both of these charges, this is one of the things i find most disgusting about the account went overdrawn by small ammount today got charged both fees and now overdrawn by 80 pounds.
    hope you can help me, not really worried about them closing my account as i have another already set up elsewhere but as I am 36 years old and have been a student for the last 4 years I have been put in an impossible situation by my bank (they refused to give me a student account with an overdraft facility bacause of my credit history (didnt have one) and by my reckoning the charges i have paid over the last 4 years are going to run into serious figures (maximum they could charge each month)

    Mick, Jo, many thanks for your posts regarding this. I got exactly the same through from the Northampton court yesterday. My Notice of Transfer of Proceedings read as follows:
    To all parties

    A defence to this claim has been filed.

    The claim has been transferred to the court covering the area where the [STRIKE]defendant[/STRIKE] claimant lives or carries on business. Please read the accompanying documents carefully [STRIKE]and note that the allocation questionnaire should be returned to the Doncaster County Court[/STRIKE].

    Where the italicised text indicates an amendment.

    If what Mick says is correct, this seems like quite a good move on the part of the Courts, in the interest of all parties concerned, let alone theirs! Lets just hope that our cases are part of the 9/10 cases that settle in full out of court!

    Very interested to hear fom anyone who has tried to claim from Barclays, and of course any advise would be welcomed.

    There are lots of successes reported in the Success Thread against them so follow the process as laid out in the main article, stand firm and ask in the forum if you come across a problem. Someone will have been there and done it and offer advice. Good luck :)

    Have a quick question, Barclays have offered me 1450.00 on a 1950.00 claim. We are going though CCCS to back back overdraft with Barclays which strangley enough is 1950.00. I know and want this amount to be put towards debt but can I ask for them to use it as full and final settlement of the debt? Hope this makes sense
    any advice welcome!

    Have just rung Barclays and they accept it as full and final payment, Yippee!!

  • Hi Everybody

    Wrote to Barclays, got no statements in 40 days. Stated they had been dispatched 1o April. No statements by 17 April so had them re-ordered. Still no show. Filed an online complaint via Barclays website, and also at branch. Yesterday received a letter from Barclays, stating that they were looking into my complaint, blah blah. Last night got a call from Barclays Head Office (London), asking me to contact them in the morning.

    In essence, I was claiming on two accounts. In my email to them I stated that, in the absence of my receiving any statements, lack of communication, etc, I would just go ahead and make the maximum claim against them in the Small Claims Court. This morning Barclays were able to tell me, OVER THE PHONE, how much my charges for the last six years amounted to. They admitted they were overwhelmed with work.

    So, and I know this won't suit everybody but it's money I thought I would never see again:

    Charges on my own account - £1110, have accepted £850
    Charges on old joint account - £1900, have accepted £1400

    They are sending out a letter confirming this.

    So, to anyone still waiting for statements, I would urge you go complain online at https://www.barclays.co.uk. It has only taken 7 days from my email to this offer. Of course, if you are after the full amount, well go for it and good luck! I am happy with £2250, it's money I never thought I would see again.

  • I received the standard letter yeaterday saying that they was looking into my conplaint and would reply in the next four weeks, came home today and low and behold they have stung me for another 30 pounds for a direct debit going out, as i am now 30 pounds lite in my account and the council tax goes out on monday that will be another 30 pounds charge, where do they think we keep getting this money from?????. so i rang them today and told them that they could stick there 4 weeks and if i do not hear anything from them by wednesday i am taking them to court. all they said was that it is taking them longer then 14 days to look in to the complaint and they would make a note on my account as to what i had said, so heres to wednesday, can't wait to get my oown back on them
