    The story so far....

    I first started my claim with Barclays way back on the 5th October by requesting my statements..they arrived some time later..I calculated the total of charges, sent all the letters sticking to my time table not giving them an inch. As usual they would'nt pay up so i started the county court claim on 5th December. As time went by I kept calling them to offer a lower amount but they wanted nothing of it and told me to carry on with the court claim. I got a court date of the 16th April. 5 days before the court date they sent me a letter offering full amount of £3752.29.The money was in my account the next day, so i withdew all of it and I closed my account at the same time. Then on the 16th April i get a letter saying they have credited my account with £129 of ACCOUNT FEE refunds and this stopped my account from closing. So I called them and trasfered the money to my Halifax account and closed my account AGAIN this time over the phone. Then today they send me a bloody paying in book and a letter saying sorry that I am not happy with Barclays and in response to my letter that I have sent them they will send me copies of my statements for the last six years??????????

    the first 3 points to include are:

    1. correspondents. copies of all the letters that you have sent to the bank and the letters they have sent to you.

    2. latest schedule of charges. the list that you printed off from Martins calculater.( i did 2 lists. one of them with updated interest.)

    3. statements. copies of statements with charges high lighted.

    Points 5 & 10 are web links. If you go to the links and print off the pages you then place these into the correct place of the court bundle. you may find that the link for the OFT report is no longer in use, so the link i used is included below.

  • I am still early on in my claim, I have sent a letter asking for charges back, had a letter saying I would hear back by the 25th April. So I stuck to my timetable and sent another letter stating that I would take them to court if I didn't hear in 14 days. So the 14 days (and the 25th) is tomorrow. I am hoping that I get a letter tomorrow. Do Barclays usually respond by a date if they have said they will? Not holding much hope, think I will be on the old MCOL tomorrow night.

    SOMETIMES it depends on how much you are claiming for, lower amounts like a £100-800 seem to get delt with a little quicker than larger amounts like £1200+. from my experience i wouldn't hold your breath on the postman bringing you good luck tomorrow. If you dont get a reply why not give them a ring just to make sure they have got your letters and see if they will make an offer over the phone. If they say they have not received your letters then dont worry i wouldnt believe them if they told me the time at midday.:rotfl:

    I have sent all my letters recorded and they have arrived safely, so they can pretend all they like! ha ha
    Good plan, I think I will phone tomorrow, if I get no luck I shall then begin court proceedings. I hate the waiting game!

  • Default Seejai VS Barclays
    Hello all,

    Barclays have put in a defence against my court claim and I am told this will now go to court.

    What do i need to do in preparation for court. Im afraid if I go in un-prepared I will simply lose regardless if I have a valid claim (which I have).

    In their defence they have said I did not provide them with the dates and particulars of each charge, but i did with 2 of my letters.

    I have also heard that Barclays normally crumble at the last minute and offer to settle. Is this the case? and if so when? Will I still need to submit the papers which I intend to rely on in court 14 days before the court date? Is this the point at which they back down? I have also lost my bank statements - will these be needed in court?

    I would be grateful of any help you can provide.

    Hi Becky,
    Im at same stage as you, althro the 14 days is up on thursday 26th, but the letter Barclays sent me said 'Id hear from them by 3rd May' which is 1 week later, will be putting the court action into force on thursday once postmans been. So will now wait and see, but like you dont like the waiting around, but determined to go to the wire:cool:

    My debts were huge - i had a overdraft on barclays acct - now closed by them probably about £1200 overdrawn at the time - i beleive charges on acct over time would be approx 3500 - Should i still follow this process?

    Even if i was successful and it worked just to pay back the debt would this be a good thing to do?

    Any help most appreciated

    Well done Vanman7, you are an inspiration!!! I am looking on here for a response to my earlier thread ? Barclays intend to defend whole claim. I have not been asked for anything from the court at this stage, does this happen when the defence is filed?
