Well done Vanman7, you are an inspiration!!! I am looking on here for a response to my earlier thread ? Barclays intend to defend whole claim. I have not been asked for anything from the court at this stage, does this happen when the defence is filed?
I don't know if you are using MCOL or your local county court.
I used my local county court, and the next stage would be to fill out AQ and then later you will receive court date and directions as to what other paper work to send in.(court bundle)

Hi can anyone advise what to do next please.
Send 1st letter off requesting charges back. Received aknowledgement letter back today, stating they will try and get back to me within the timescale outlined in my letter, they cant guarentee it. They aim to find a solution within 4 weeks , but if not then it will take 8 weeks for them to send me a full update.
Do I just wait for the 14 days to elapse, then send them a letter stating my intent to take them to court? Shall I stick to my timescale throughout the whole process , even if they say they will respond by such and such a date.

I'm in the same boat. Got a copy of Barclays defence statement - 10 points on it. Most seem to be legal jargon, but I too noted they contest the claim on the grounds of incorrect / missing information on the actual MCOL claim form - account number actual details of charges - date and what for.
I'm more concerned about point 10 which states if barclays are not allowed to claim these charges they will start action to recover their losses wich could total more than I am claiming for. Is this just scare/bully tactics or can they actually do this?
Any help on the defence statement etc would be appreciated0 -

Yes Marytmoose, you stick to yr timescale, not thiers stick with it & good luck. ive sent my letter, letting them know I intend to take them to court, they got till tomoz, (not holding my breathe) then start the court action, getting nervous, but still determined.Murphys no more pies member 48:beer:

I have followed all the steps but so far Barclays have refused to cough up. I now have a hearing date for next week. Have many other people had to go this far? I'm only claiming about £500, not millions! I thought they may have backed down by now.
I am still going to go through with it, but I hadn't expected it to get this far!

can anyone help, i have got as far as making my claim online, thought i had won as no defence was entered but they did enter one at the very very last minute so i now have to go to court. This is Barclays Bank i am talking about. I have recieved a Notice of Transfer of Proceedings which encloses the banks defence which is fine but am i supposed to be doing anything?? The Notice letter does have a line stating please complete enclosed allocation questionnaire but it has been crossed out, is this usuall or will it come separtley??

Just spoke to my local court.
they say that in cases dealing with bank charges the judges have ruled th AQ forms are dispensed with. The judge then asks all parties to submit full evidence for claim and defence so that he can view ALL the evidence . They say 9/10 times the banks back down from this as they have to produce a listing of FULL costs etc to justify their charges in their defence. They say that in most cases the banks will call you for a settlement out of court.
I think I've got it right (I hope So) unless anybody else knows different0 -
Thanks Mickh115, so i dont need to be doing anything, i just sit and wait to hear from someone now? Knowing my luck i will be the 1 out of 10 that Barclays dont back down from and end up worse off than i started!!0

I'm in the same situation as you.
As I said, the court told me today to wait to hear from them which should take about two weeks. So fingers crossed I don't need to do anything until I hear from them0
