Hi, I'm a newbie.
I sent a letter asking for £1795 back from Barclays. I received a letter back saying they were looking into it and wld reply before 11th April. I followed my schedule and 14 days later I sent them the letter before court action. My letter crossed another letter from them in the post which said that to help resolve the matter they needed to collate more info and wld contact me before 8th May. I have about one more week before I shld be taking them to court. I think I shld go ahead anyway as I cannot imagine what sort of info they wld need to collate. I sent them a full schedule of the charges, plus interest, what exactly do they need to know? What does anyone else think? Has anyone else received letters like this?
Thanks, Caroline0 -
Nadeem, I got my statements for the last 6 years from barclays no problem, so it is possible. I didn't ask for one with just the charges on though, I just went through and added up all the charges.0

I've got the same thing!?!!?!! I knew they would defend it but kinda hoped they'd forgot about me...
Did they actually send you the allocation questionnaire to fill in pitprop? Dispensed..Sounds like the judge has said that you don't need to file a A.Q...maybe....
Nope the judge at MCOL has ruled that the AQ be dispensed with so I have not been sent one. However what do I do next sit and wait for a hearing date? sooooo0 -
Hi
I sent my letter as advised by Edinburghlass and Twinkly ..... stating that I accept their offer in partial payment and without prejudice, but if they do not offer the full amount within 14 days, I will proceed in court. Time is up, I have not heard anything, so shall I wait any longer? appreciate your good advice.0 -
sit and wait for a hearing date? sooooo
That seems like the most likely thing to happen...The judge has saved you £100 at least...I think the judge has actaully sped it up a little for you..He's probaly choosen the allocation/track (in court) that you need (having seen so many similar cases) and saved time by not asking you to send paperwork back an forth, and then wait for a hearing just to look at that paperwork, and then give you a allocation/track an date for your claim..pretty sure thats how it works..
'WHAT DOES ALLOCATION MEAN?
The courts recognise that all cases vary and will require different timescales for hearings. To cater for this diversity, the rules create 3 different categories of case management - TRACKS. The AQs, along with the original claim form and any defence, will help a Judge to determine the track for your case. This process is known as the allocation.'
Got this off CAG website^^^
Might be worth asking them if they know anything about this...Their pretty good on the legal stuff, they've got the court bundle your gonna need (if it gets to court) on their website too...0 -
