well, by the sounds of things, i'm one of the unlucky ones who's off to court!
Barclays have decided to defend, and sent back there response, about 44 pages FULL of large words, all very frightening!!
So, i was wondering if anyone can offer some advice,any words of encouragement!
I'm going through with it, i;ve decided that! I have no money, and so if i do lose, then, well i;ve lost already!! But not backing down scred from them!
If there are any words of wisdom then i;d appreciate it, just so i'm kinda prepared!!
Not sure what to do next even!!

Don't worry, it's virtually unheard of for a bank to defend themselves in court ... all scare tactics. They don't want to risk losing (which they almost certainly will:rolleyes:).Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
That's not really what I wanted to hear as I'm just about to take the step of commencing court proceedings but I'd have to agree with the others that it is all scare tactics....
I'm just about to send them the 3rd letter informing them that I am commencing with court proceedings and give them my new total which includes interest.
Could someone please advise what this step actually consists of? I'm figuring that I send a letter to Barclays, register with MCOL and put forward my claim. Is that right? How much does MCOL charge?0 -
Im about to send off my first letter asking for 6 years past statements from my Barclays account.
Anyone know what Barclays' address is? Do you send it to your local branch or the main Correspondance Leicester Branch?
I have been hand-delivering ALL of my letters to my local branch and i have a court date on 16 April. so it has worked for me, and this way you can safely know you letter is in their hands, so why not pay them a visit. no need to talk to them just hand it in to any cashier.:p
....Oh and by the way.. you will walk out of that bank with the biggest fattest grin on your face that you have ever had.. TRUST ME.:rotfl:Not just a white vanman:cool:

I have recently been going through the motions of claiming whats mine back from the dreaded BARCLAYS. Martins advice was to time the processes to the second if you could. However Barclays filed an acknowledgement of service at the last second which gave them a further 14days. The 14 days was up yesterday and no defence was entered, so at 1 min past midnight today I filed for judgement by default.
Great I thought until ...... I phoned MCOL this morning to check everything had been done right. It had but was told that my default would not go on the system until Tues next week due to them closing at 4pm today. Barclays can still file a defence up to the point of MCOL registering it on their system (Tues). In effect that gives Barclays a further 5days to file. I thought that by processing it before 9am this morning it would show on the system today.
Seems to me that the MCOL system is there to give the defendant more time to delay. Its my £120 they are working with why don't they recognise the strict time limit given to Barclays. ie Barclays should have filed by 4pm yesterday.
So beware the online system does give the defendants a few more days than is stated on the papers.
Sure enough my on time to the second application for judgement by default has been rejected and Barclays late defence has been accepted :mad:0 -

If you havent already check out this thread for details of addresses to send things to. Barclays sent my statements free of charge. Barclaycard charged me £10. Both the same company though... go figure?!Sorry but please keep your signature to 4 lines in length - MSE Forum Team 20 -
anyone going direct to barclays I advise not to bother ordering statments over the phone as i requested 3 times and never got. Go into your branch and manually do it as soon as i did that I had them a couple of weeks later. Do not deal with barclays over the phone at all if you can help it they are useless.0

I recevived a letter from barclays this morning offering me £875. My original claim was £1225 (or £1095 without interest). Am seriously considering accepting this as I am skint and also could do without the hassle of court! I'm planning on having my wages put into my parachute account (woth Smile) and gradually paying off the Barclays overdrafts (I have 2) then closing the accounts. Firstly, what do you think of the offer? and secondly, will Barclays get snotty when they realise I'm not paying my wages into the account anymore and demand I pay the overdrafts off immediately?0

I rang Barclays the other day to say I had heard nothing and that I had sent my letter off on the 20 Feb to get a list of charges and was dismissed very rudely being told that they had a back log due to so many people contesting the charges and I would have to wait.
It wasn't untill I advised the fact they were already over the 40 days that they are obliged to respond to me as per the Datra protection act they agreed to make a note of my call and give me a referance number.

Just an aside, a few years ago, when I was married to my ex-husband, I had two accounts with Barclays, a joint one and a graduate one. My salary got paid into the joint one and I used to transfer a proportion into my graduate account. One day I went to the cash machine to withdraw money from my sole account and the machine ate my card. When I went into the branch to enquire why, they told me that, as I wasn't getting a salary paid into the graduate account, they had no idea where the money was coming from, so they withdrew my card .... BIZARRE. No letters, no phone calls. They also demanded I repaid my (small) overdraft. I told them to get knotted.
I am now going to get REVENGE on them, claiming back hefty charges from the last six years, on both accounts.Claimed back in 2007

smithy i had the over 40 days thing with barclaycard (barclys actually sent my statements in good time). i suggest that anyone who has to wait beyond the 40 days for DPA info contacts the information commissioner to complain. if enough people complain then it will force them to behave properly and could result in further action against them. also it wouldn't look too good from a media exposure point of view.Sorry but please keep your signature to 4 lines in length - MSE Forum Team 20
