  • I've just had my 2nd reply from Barclays, AGAIN saying they're looking into my complaint and they will reply on or before 24th April. I ignored their timetable for my initial claim and waited for my 14 days to be up before sending the 2nd request. If I stick to my own timetable again, I should be writing to them on the 10th April this time threatening court. But I haven't had any kind of offer yet - or refusal for that matter. Shall I carry on regardless with my threat of court or shall I give them chance to make me an offer on their timetable in 3 weeks' time (which by the looks of the previous posts will be short of the £1300 I'm wanting).

    I've been trying to treat this as if I'm the same computer that dishes out the charges, i.e. unfeeling and uncaring, but I must admit their refusal to even acknowledge me as an inidividual with a grievance is unsettling me and making me feel nervous. Their methods are obviously working! and that makes me angry to think they can intimidate people like us in this way.

    Any further advice on what my next move should be?

    As soon as you get youre money that they took illegally, close down youre account and leave them, Barclays are using tricks that criminals would use, and to think we all trusted them with our money.

    I will never step foot in a barclays branch again , and more are following ...
  • Only a dimwit would send cash through the post, by unregistered mail. Only a dimwit would do this with their clients’ own money. And only a dimwit would pen and sign the accompanying letter.

    In any sphere of commerce, an employee who performed such an act would
    be hauled up on a charge of gross industrial misconduct and justifiably dismissed.

    But a towering figure of financial probity, who languishes at a big 5 high street bank, was that dimwit.

    In a brief moment of supreme and breath-taking stupidity, this knight of the fiduciary, did just that in a response to my spoof donation missive, no doubt enraged by it’s contents.

    And just who was that dimwit? Step forward Group Chief Executive of
    Barclays Bank PLC, John Varley.

    Dear Mr Varley

    I am writing regarding your net profits in recent years which I'm sure you'll agree are very small indeed. It must be enormously disappointing after putting in so much hard work and effort only to be rewarded with a bottom line of a paltry £178 trillion. It must be sooooo difficult to motivate youself yet you somehow manage to carry on in the face of adversity with
    the same passion, dignity and not to mention honesty. I have nothing but the highest admiration and respect for you personally and your bank as a whole. You're a hero.

    Is it really true the entire UK banking industry only managed to coin in £4.6 billion from current account penalty charges last year? Talk about tough times. It baffles me how you manage to keep the ship afloat.

    But I want you to know that the whole nation is right behind you and soon every decent citizen throughout the land will be digging deep into thier pockets and donating all they possibly can to help you through these desperate times.

    Myself and my family have been very busy raising funds already. Although I'm blind, limbless and confined to a hospital bed, I've tried to do my bit by washing cars, busking and even selling my kidneys to the highest bidder (the pair fetched a heart-warming £1.72p on e-bay!} as well the 11 quid my 7 year old raised since I put her downt pit.

    So please find enclosed £20. Not much I know but at least it'll get you a half decent glass of claret.

    Also expect a package from my elderly mother who's put together a few tins of soup and a packet of low fat muffins for you and your family. She's terribly worried that your parlous financial state may mean you're not eating properly.

  • I believe I have just had the best result ever in claiming back bank charges.

    Last year I was charged over £200 in charges and 2 weeks ago I phoned up Barclays to try to claim the money back.
    At first I was made the standard 50% money back offer which I declined straight away.
    I then went into the whole speel about the charges being illegal and that I had seen a several programmes on the tv recently and also read about it here.
    I also pointed out there is a massive thread on MSE on how barclays deal with these cases. So I said what is the point of me sending off forms, you refusing to pay, me filing a legal claim, you contesting it and then a day or so before the hearing either making a full offer or just not turning up to the hearing.
    Today I got a letter in the post saying that even though I had incurred the charges through neglect of my account, on this occasion as a gesture of goodwill all charges has been credited back into my account and no further action will be needed to be taken by either party.


    RESULT.

    Yeah excellent result OP.
    As an extension to this I have to say I've wondered about all this claiming malarky, exactly as you've said in your post there, I mean seriously, what's the ******* point?

    God only nows how many people are tied up one way or another administering all this, apart from the claimants' (I'm not one) own time, effort and in some cases stress,.... despite the inevitable outcome.

    There shouldn't even be the necessity to make a phone call actually. Surely by now there is a fairly indisputable precedent as to these charges being <insert correct terminology> wrong, and so any charges incurred by anyone during the permitted period should now be voluntarily refunded.

    Doesn't affect me personally but what started out with one aggrieved but astute individual taking on the bully banks and winning has turned into something of a farce. You could almost feel sorry for the banks, not that they wont get it back somehow else, but that's another story...

    So I've filled on line for my money back. I'm told that the date the pepers are served is deemed to be 5 days from date of filing, in this case 3rd of April 2007. So are the five days up on April 8th (Sunday) or is it 5 working days.
    14 days after April 8th is April 22nd (another Sunday) If they haven't reponded by then can I enter judgment on the 22nd ready for the morning of the 23rd?

    I'd say you've got that right m8...i think they just allow 5 days (not working) for them to receive the papers in the post...the court/MCOL will write to you to let you know this info anyway, in the next day or two...
    P.S. I bet ya that their dealing with both your claims as one...thats why they haven't written...none of my letters were very clear that they were talking about both my account claims, infact going so far as, none of the letters have my joint account or sort code numbers on them but on the phone their adament they are making an offer/talking about both....

    I’m seeking the advice of the experts! I am in the process of trying to reclaim money from Barclays Bank, I have gone through all the letter writing and have now moved on and filled out the form online for the small claims court. The claim was issued date is 26-3-07 for just over 2k! So what I want to know really is when do I ask for the judgement? Is it the 9-4-07 ie 14 days after or is it longer with it being 2 bank holiday days in that time? There is also the part about waiting for 5 days for the claim to be served! So do I wait 5 days from the 26-3-07 and then add on 14? Do the bank holidays count?
    Many thanks for any advice.
