When I sent my original claim I did not include interest but on Martins 3rd standard letter the court claim states that I will be claiming interest. Use the 'Statutory Interest Calculator' on this page m8...just put in the dates and amounts you was charged...you might have to copy the info you get to excel or word spreadsheet as the dates you get back are U.S (ie. 2nd april 07 reads 04/02/07) nor are their any details of the charges (paid referals, refused cheque, etc) which you will probaly need once you go to court...

Just a quick question, i have sent the second letter requesting full payment or in 7 days i will take them to court. That was on the 13-3-07, Barclays replied with an increased offer of £1410 (up from £1200) Now my question is do i HAVE to respond to this offer or, as the 7 days are up, can i file a claim (on mcol)?

Ring them and ask if this is their final offer...if it is, you can file your claim online as you are now in stalemate with barclays and won't be able to procede without the help of the courts...0 -

Just read the last post! I sent in two claims, one for my personal account and one for a now closed joint account. Delivered them by hand originally in the same envelope.
Have only had a reply re my personal account and second letter offering £500.
I have made an online claim as they have not offered the requested amount and have a reply ready to go this evening saying that I would accept the £500 as part payment without prejudice and continue with my claim, also pointing out that I had not received any sort of communication re our joint account.
Have I jumped the gun?

Can anyone advise i wrote to barclays asking for my charges back, they sent me a letter 3 days later saying that they were dealing with it and then 2 days before the 40 days were up they sent another letter saying that they werent able to deal with my complaint fully at present but will within another 4 weeks!!!
are they allowed to do this and if not can anyone advise on the next steps i do

When the 40 days is up, if you don't have all your statements, advise them they're in breach of the Data Protection Act and you will be informing the commissioner. If they continue to stall, you ask the court to enforce if necessary.0 -
Done the interest calculations and that works out an extra £400 or so
Kinda hoping they do reject my figure now....

I doubt it will matter too much...they was never gonna offer you the full amount that you asked for, as proved in the success thread with a large number of people settling for a lesser amount than they orginally asked for, just to get it over an done with or else barclays was gonna drag it out....write to them rejecting their last offer, and say you will only settle for the full amount...make them aware that you have now started your claim in the courts as you warned you would, and will only stop procedings once full payment has been made...Theres a rejection letter 'template' on here somewhere but god knows where.......0 -
I called barclays up last nite on my way home to make sure that they had recieved my letter, royal mail advised that the letter was receieved on monday 26th march, but barclays adivsed me that they only received it on wed 28th( could this be down to barclays have poor internal mail service), and that i would have a answer in 14day from the 28th,
im not to sure how to procced, im wanting to get the nxt letter sent of now as their 7days that i said in the letter that they had to sort it out is up, but should i wait untill barclays 14days period is up?? (this would take me up to the 11th april)
please help, is this just a delay tactic, should i send off the next letter saying your going to court if its not done???0
