    hi thanks for the help will get on to that in the morning as brain really tired now, and it might take little old me a while to do it as not to quick with computer. heres hoping i get it done ok.

    Ring them up and ask whats happening...if they start telling you its gonna take longer than you asked because of prior 2000 data, explain your request only goes back as far as 2001 and then quote them the DPA if they say its gonna take longer than forty days to get your statements to you 'because they have no legal obligation to comply to any data protection laws, and therefore the 40 day period was irrelevant'....threaten to take them to the FOS/FSA on it if they don't comply but i'm sure they will...Might be worth sending a copy off to FOS/FSA with a complaint seeing as you have it in writing, along with your Request letter, so they can see what barclays are doing....

    I wouldn't bother trying to accept and continue your claim as they never seem to give out partial payments if your going to carry on your claim for the rest of the money...send a letter back refusing this amount..'maybe' put a figure you would accept if offered (£2000??)...and then remind them that its now in the hands of the court and put the date of your hearing...and that your looking forward to seeing them of course!!!

    I know its my timescale but How can I be sure they have received my letter?
    Royal mail say its not got there so why have they sent me a letter saying they were sorry I have needed to complain?

    Im gonna have to wait until I get confirmation of my letter.

    Thanks for the reply. I have written to them explaining that data prior to 2000 does not concern me. I have explained all this and still no joy. Will try what you said. what does fos/fsa stand for by the way? thanks
  • Yeah a couple of people posted a standard response type thing of which I have just sent back myself it went something like this:

    I am very grateful for the speed and graciousness you are showing with my claim, thank you. However I will not accept your offer of £xxxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but I will continue with my claim for the full balance of the charges.

    Hope that it works!!!

    Well it didn't :(

    I got a response back today (pretty quick!) stating that they will not increase their offer of £1655 against my £2260. I intend to reply suggesting an amount I will accept or we'll take it to court.

    If theres a ref and tel number on the letter, ring it quote the ref and ask if anything has happened and on what date did they receive your letter..they've quoted mine to me almost every time i've called..(Royal mail must have delivered it by now!?!) they'll probaly say not much has happened as they are really busy..8 weeks..blah blah blah...

    FOS - Financial Ombudsman Service / FSA - Financial Services Authority
    Just checked and it looks like it would be the FOS you would complain to...
  • i recieved an offer from barclays for 350.00, they owed me 1200.00 with interset on top. i have refused this offer and am now going to court. the bank sent a defense stating that some of the fees were over 6 years old and that i had not sent evidence to back my claim up. i did send a copy of the bank charges calculator with my letters, has anyone had this too? surely the bank already has access to my account, why do i need to send them the statements i paid for????:confused:
