    I've gone through most of the process with Barclays and have filled in the Allocation Questionnaire form to have the case heard at my local County Court (Peterborough).

    I sent the form back on 9/3/07 but it seems they do not pass this to the District Judge until the end of the period given for submission (25/3/07).
    I just spoke to the court and was told in a very offhand manner that the case would possibly be listed 'some time in May or June'.

    So I guess I will just have to wait. This does give our friends at Barclays a lot longer to hang on to my money and the opportunity to establish an acceptable charge at a test case.

    I will keep at it but I'm starting to lose faith that I will get a really successful outcome...

    Didn't get into town yesterday - and was just all ready to go about half an hour ago and the statements have arrived . They have come from the Customer services centre in leics. no mention of anything other than here are your statements. AND!!!!!!! they've kept the postal order! The cheek of it! (to be fair, if it costs me a tenner to get all the money back i couldn't give a monkeys!

    so.......am going through statements with a fine tooth comb. buga the ironing, this is more important!

    After sending my first demand for my money back, just over £1000, I received a letter back stating that they would contact me by 21st March, which came and went, gave them a few more days and so yesterday sorted out the second letter which I haven't posted yet. Lo and behold I get a letter this morning offering £795 which I will accept.

    Have just filled in the court allocation questionnaire - I don't really understand it, I'm doing it all on trust :eek: Please please someone tell me it'll be OK and I won't end up in serious trouble somewhere, because I've never gone out on a limb like this before.

    I copied the text from the 'help' thread, but then added something at the bottom about 'I am also reclaiming the interest on these charges at the statutory rate of 8%' because I got really confused filling out the initial form and it appears I didn't claim the interest when I entered the court proceedings (it looked like it would do that for me, but it doesn't seem to have done) - should I have just left that alone?

    Feeling very ignorant and hoping I haven't messed up :( So what next?

    i have read that the banks have 40 days to send out the statements once you have requested them, is it 40 working days or just 40 days total?
    also does the bank account get put on hold so no further charges can be made til they have re-paid the claim? :confused:
    as i am currently well over my overdraft and they are adding more charges to it!

    I've just checked my MCOL and barclays have acknolegded my claim giving them another 14 days from today to enter a defence....no letters sent by them or me since 9th march when i was offered 20%ish of my money back....

    40 days total..No it doesn't get put on hold..best bet is to ring and complain about the most recent charges (those within the last month or 2 maybe??) and see if they will drop them...If they won't, add them to your claim...
  • Finally got my statements through after about 50 days !! I have just written the letter asking for the charges back. It comes to £830 with interest..£730 without. One thing i have noticed is I have a lot of unpaid DD's when i have had more than enough funds in the bank. admittedly they haven't charged me for these, but i've had late payment charges from the companies involved. Around £180 in total. Who is liable for those charges??

    I have also managed to pinpoint the time when i got into financial difficulty by looking at my statements so thats not a bad thing. I didn't have any charges from 2001-2004 which is when i wasn't working due to a motorbike accident, and before i got married. Suddenly i get married and BAM! charges galore. Therefore i blame this whole mess on my husband :D

    Hi, not posted that much on here but I thought it was about time.
    I sent off for my statements on the 21st Feb without the £10 cheque. Luckily I recieved my statements on the 12th Mar, a lot sooner than I thought, especially with me not sending the £10. Although saying that, my brother received a letter from Barclays last week saying that they were sending his statements free of charge, and returned his money. Has this happened to anyone else?
    I totted up the charges over the last 6 years and sent the letter asking for the money back on the 19th March. The letter has still not arrived at the bank after 9 days! I have sent parcels to Australia quicker than this!
    Anyway, thats as far as Im upto on this.
    One question I had was, with the OFT ruling in a matter of days, will it apply to claims that have already been set in motion, ie my letter having been sent before the ruling? Im guessing it will affect all new and ongoing claims.
