  • Good afternoon,

    Long time reader, first time poster hoping for some advice on this 'parking fine' issue.

    I received a letter this week after parking in what I deemed to be an overflow car park. Having read up on this a lot I know I should have just ignored the letter.

    However, when the letter arrived, I was quite shocked and gave them a call to ask about it because I had seen no signs saying you couldn't use the car park. Now they asked me for the reference number and so I am a little uneasy now whether I have somehow admitted any sort of liability by making this call...

    Can anyone offer any advice or reassurance on what I should do?

    Ok thank you, I see what you mean. The reason I was a little more concerned is it was my partner's car and they are worried about ignoring it.

    The guide I read on here suggested writing to say "I was not the driver" etc etc, so I was wondering whether this was something that should be done to try and prevent them from making further contact.

    Just thinking that when the debt collector letters start to arrive my partner will be a bit annoyed and possibly decide to pay rather than put up with the hassle!

    Absolute scumbags!!

    It's like a protection racket and you wouldn't try to appeal that!

    One proactive thing we may suggest is to complain to the retailer if you were visiting a shop where the car park signs were not clear. Not worded as an appeal, worded as a very strong complaint - how dare they allow these scumbags to harass their paying customers - that sort of thing.

    The other proactive thing for the determined is to collect some threatograms and then write and threaten to sue the PPC and the landowner/occupier who contracted them, for significant damages for harassment. Worded properly, it has worked ('Give them FA' who got a grand I think, in a payout in Court from a debt collector acting for a PPC). In fact if you decide you are up for going this route, then it's one of the few times that writing to say the keeper was not driving IS in fact recommended in the first instance, to establish that any contact after that is actionable as it's clearly harassment of the wrong person.

    I could possibly write to the establishment a complaint letter. If there is much harassment the latter idea sounds interesting, will keep it in mind.

  • My partner and I are in a very similar position to a lot of you guys too.

    The difference is I am disabled but had not yet received my Blue Badge and we parked in a disabled parking space just outside Boots in Cardiff Bay Retail Park.
    As we were returning we noticed a kid taking a photograph of my partner's car and my partner quickly ran to him to ask him what he was doing.
    The kid replied that it was just a routine photograph to see the state of the parking space and in no way was him taking photographic evidence for any parking charge. We had no other choice but to take his word for it and my partner was not very confident at all.

    A week or so later we received the first letter stating that we were being charged for illegally parking in a blue badge holders space and the charge was £75 - £65 if paid within 7 days.

    I sent them an email explaining the reason for parking in the disabled space, that the car is registered as disabled and I have medical letters and surgery reports to prove that I am not the type of person to park in a disabled space if I thought I wasn't justified in doing so.

    An email was sent back the next day saying no appeal was granted and that the outstanding charges still applied but as a good will gesture it would remain at £65 if we paid immediately.

    I looked them up online and phoned various relatives and all suggestions led to ignoring them so we did.

    My partner had a phonecall from a debt collection agency who said the debt had no been passed to them and stood at £150 and a letter would be sent out which we received today.

    If it was up to me I would continue to listen to the advice I have read here from you guys and completely ignore all letters from them but my partner is very worried about this and as it is his car I can't force him to ignore the letters like I would.

    I'm a bit worried that even if I manage to persuade my partner to ignore the debt collectors letters that as soon as the solicitor's letter that the rest of you have had arrives he will be even more worried and tell me he's paying it.

    Is my case still the same even though I have parked in a disabled space without a blue badge?
