Can I claim back charges off a closed account???

  • I apologise if this question has been covered elsewhere, I did try to see if it had, without success.

    What I would like to know is whether the account that one wishes to reclaim charges for has to be active, I had an account that I closed due to the high subscription charges for services we did not use. Do I have any chance of reclaiming charges from that account now it has been closed?

    Hoping someone may be able to help, thanks in anticipation!

    Yes you can claim on a closed account. Write to the bank requesting your 6 years details giving details of the account number and your full name and address with postcode. It may be necessary to include your date of birth, previous address if applicable and the type of account it was.

  • I have run my account a lot better with my current bank, who I have been with for the last 3-4 years, so am not interested in pursuing them! however, my previous bank was dreadful and I probably paid them the equivelant to the G.D.P of most small countries when I was with them! Does anyone know whether I can pursue them for these charges, even though i no longer bank with them? Thanks for any assistance. Darren.

    Yes you can claim from a bank you are no longer with check the forums where it has been mentioned and how to go about it. Good luck keep us up dated

    I am in the process of trying to reclaim charges from my old Natwest account which was closed in 2003 due to charges getting me in to terrible debt.

    I wrote to my branch with a cheque for £10 as per the advise on this website but they replied and said that they needed the account number and sort code, which obviously I dont have! Does anyone know what I can do to get this info? is it possible to reclaim the charges? I am also looking to reclaim on the old credit card i had with them.

    Any advise will be grately recieved.

    I used a letter similar to this below for accounts that are no longer active in my name.

    Re: Data Protection Act 1998 request for statements of account.

    I do not know my account number, and if you have trouble obtaining the account from the above information, my date of birth is xx/xx/xxxx.

    Please send me the information which I am entitled to access under Section 7(1) of the Data Protection Act 1998 (the ‘1998 Act’) in relation to all charges which you have applied to my above noted account within the last 6 years from the date of this letter.

    If you require any further information please let me know as soon as possible.

    I understand that you charge a fee of £10 for this service, which is enclosed.

    I look forward to your response within the maximum 40 day time limit under the 1998 Act.

    A natwest credit card manager will be contacting me tomorrow, what do i tell them to try and convince him to give me the cash back tomorrow.

    That the charge consitutes a penalty in that it is an excessive charge for any actual loss incurred by them. That is is unlawful because of its excess. That you would be willing to pay what it actually costs (there's no way in hell they will tell you what it costs) but failing that and in the event he doesnt refund immediately that you would be entitled to claim this back in the small claims court under current legislation governing unfair charges and intend to do so.

    There will probably be some arguement from him that the OFT considers £12 a reasonable charge (as stated in their April 2006 announcement and the credit card companies brought down their charges accordingly). You can counter this by saying that you consider £12 as still excessive, that the OFT is not law and in the absence of proof of actual cost you are willing to go to court on this matter.

    Read through the reclaiming threads, plenty of people are successfully claiming back this charge in this manner.

    I contacted them, they women on the end was unsure on the law and said that they cannot be refunded. I explained that its unlawful to charge more than what it costs, and that all they have done is add a charge to my account for the 13th Mar, when i sent payment a few days earlier. The payment went in on the 14th Mar.

    Its a natwest credit card, i paid from my natwest online account, through the online natwest credit card pay facility. (computer to computer)

  • hi all,iam new on this site and need some guidance,i got into trouble a few years ago with debt,i am sorted noe but could do with reclaiming some charges,i have claimed my bank charges backk successfully from the halifax,can you also do this with credit cards.i had a cap 1 with a £200 limit went over and paid back with charges £366 but this was a short settlement the real amount was £487,mbna was the same credit limit £2000 paid back £3402 with charges,can i claim these charges back of these companies,thanks
