    Just an update really.

    March sometime, i (me & gf) went into my local branch to ask for the gf's cash back from the charges on her account. Was told that i cant have it back as they believe it was fair etc.

    April 15th sent them a letter asking for the bank charges to be refunded, only came to a total cost of £198 in the past 12 months, told them we were not going to look back any further as the gf cant remember any charges that were made before she got her overdraft anyway.

    Received no letter by the 1st may, so sent another letter recorded delivery, still by about 12th may no letter from the bank, got the gf to ring the customer relations office who said they have an offer and that it is in the line of being sent out to us and that they have up till the 31st may to reply to us. I think we had itchy fingers to file the claim with the online courts.

    Anyway, i went away with work on the 15th april to cyprus, returned last night to find out that they sent her an offer of the £198 in full, and she returned the letter accepting the offer.

    The next step is to chase up the cash to see if it gets into the bank account, then get the gf to reduce the overdraft down from £200 to £50.

    Maybe in the long term, it could be worth waiting for the bank to reply, as if i filed the court & interest route it would of ment alot of stress and hassle for us both.

    Shall report back when the cash is in the bank, well thats if it arrives.

    I have followed the process all the way through sticking exactly to timescales etc. After submitting the detiails to Court the final day for Nat West to put in a defence is here today. Unless I have a letter at home this evening, I win by default.

    What do i need to do next? Do I have to instruct the court to enter a judgement against them and I can then send in the bailiffs, Oh and a team of Photographers?

    PLEASE HELP!!!!!!!
    I have just recieved my latest letter from MCOL it says that the case has been sent to my local court,but I have no idea what to do next?????? All I keep hearing is """be prepared""" with what?? I started this back in January and am still waiting for an answer one way or another,my bills are mounting up and I need to get this money back from the bank so I can pay off my debts,I am taking NATWEST to court for nearly £2000 they offered me £1000 but I declined,I have heard nothing from them since please please please help!!!! Getting worried now!!!!

  • A quick query, In response to my Freedom of Information request I had 6 years of bank statements back (with plenty of duplicated pages which I had to sort through and remove).

    These don't distinguish between account fees (for my missold Advantage Gold account) and charges - I have no way of knowing what is what historically, I have claimed for the full ammount where no distinction was made in their F-of-I response.

    As they are not complying with my request for a breakdown of charges under the F-of-I act is this ok?

    Don’t panic. Whilst taking a bank to court is not something to be entered into lightly, you have a right to justice. The bank does have every right to defend your claim against them. However, the legal jargon their solicitors use is designed to intimidate you into giving up.

    The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you might need some other more legal documents, but we can tell you what you need and where to find them. One set of copies will be waste paper, because the bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc.

    Either the court and/or the bank's solicitors will be in touch with what information they now require from you. However, if you have a read of the previous posts there is nothing to stop you getting in touch with the bank and asking if they will make a better offer which you would be prepared to accept without your case actually going to court.
  • could someone help..... I sent my second letter to Natwest, coinfirming that they had 14 days before i go ahead with Proceedings... on the 14th day, i recieved a standard response saying it would take 6-7 weeks to process.... what should i now do? GO ahead with Proceedings or wait for the 7 weeks?!

    HELP!

    Thanks so much. i recieved this letter from Natwest 13 days after the initial request letter. telling me i would need to wait 6-7 weeks on top of the 14 days i had waited for this reply..... Would it be just as effective for me to go into the local County Court instead of going through MCOL and do it that way?!

    Im sorry not too sure about this but there is a whole thread about claiming via the court not MCOL here

    It will have some useful info on it i expect. Natwest are suppose to deal with enquiries for claims 8 weeks from the start so the timescales they have given you would be just over probably right now as when i was claiming they said they had been inundated and were going over the 8 weeks.

    I have only just received my offer letter 11 weeks after i started my claim, i didnt do MCOL as i couldnt afford to at the time of the 8 week period however i did put in a complaint with the FO.

    I really dont know if it would have been any quicker for me to issue court proceedings as they didnt seem to have any method in what they paid and didnt pay out. I read lots on here all with different timescales and amounts and they all varied.

    So its pot luck i think. The decision is yours good luck with it anyway and keep us posted.
