claiming via court not mcol

hi, has anyone actually claimed via the court route and not used MCOL? if i want to use mcol, i will have to wait until beginning of may at least beofre i can scrape the money together. but, if i go to my court, i can issue claim on Friday (when time is us) as i am exempt from fees. any help would be great!

I've put my claim in via sheffield county court this morning..........found it better than online as the clerk went through all my paper work an checked it for me and all was fine.............my fee was £250 cause claim is £5000+......so go head down to your local court.........they are helpfull.

hi, can anyone help when completing the form N1 to take to court? have pasted the particulars of claim, am stuck on "brief details of claim", i assume "value" is the total amount claimed (charges plus interest?", at the bottom of page 1 there is "defendent's name and address" - have already put that at the top of the page - do i repeat it here? also, is it ok to type onto the form and print it out or do i have to handwrite it? all advice greatly appreciated!!!
sorry - more questions! if i file at my local court, can i still track, enter judgements etc with mcol? if not, how do i do that? also, i kow i saw somewhere what to put in "brief details of claim" but i cant find it anywhere! please help, as trying to get this done before baby wakes up!!!0 -
just remember that you cannot save information on the pdf n1 form it has to be printed off when finished........so double and triple check..........claimants (your name an address ).......defendant (banks) and yes also at bottom of page.............brief details of claim quote..."Money claim for return of penalty charges applied to the Claimants bank account by the Defendant"
total claim = charges + interest@8% + overdraft interest(if claiming) + court fee

I am also going to file my claim in person at my local county court.
Have filled in N1 form and also the Fee Exemption form ( as I am receiving Benefits) and printed them out ready to go.

well done justlaugh! am taking mine tomorrow, if i can get a babysitter as not sure courts will have life - am asssuming it is the county court (which is upstairs) and not the magistrates court (which is downstairs!)
forgot to ask, are you exempt, and if so, did you take proof of benefit etc? were the court welcoming, or did they look as like "oh no, here comes another one!0 -

The longest part was waiting in the queue! (there were 3 people in front of me)I took my daughter along with me. Yes i am exempt and my claim is just under £5000 so i would have had to pay the maximum if i wasnt exempt.
The man was very helpful and made sure i had copies for myself. I had filled in and printed out the N1 form ( you need 3 copies 1 for you, 1 for the court, and 1 for the bank and i think the court charge you for this if they have to photcopy them for you) Also 3 copies of the list of charges.
I also filled in and printed out the application for fee exemption (EX160)
I think it saves us and them alot of time if we already have the forms filled in and our own copies.
I took along a letter telling how much income support i get ( take your most recent one and they will photocopy it and give the original back) also the most recent bank statement showing benefit going in.
I also took along copies of my correspondence with the bank and ID but he didnt ask to see them.

Hi, having filed my N1 at court last week, was wondering if anyone else is claiming through their local county court? am lost as to what happens next to be honest, will i hear anything if the bank puts in a defense, or do i have to keep ringing the court?
thought we could have our own N1 support group going!!0 -
Filed my N1 at wandsworth county court ;ast thursday and was wondering the same thing so i asked a solicitor friend what happens next.
He said I should receive a letter telling me that the claim has been sent to the bank and will also give me a date ( this will be an estimate of when they received it)from which the bank will have 14 days from to acknowledge the claim, once they have acknowledged the claim or the 14 days are up, the bank will have 28 days ( or maybe its 14) to submit a defence. Something like that anyway!
Or to put it simply, the court will send you a letter telling you what happens next and the timescales for deadlines.
