hi, this is what natwest did to me, the day before i could issue a default judgement a defence dropped through the door. They said had not supplied enough evidence and wanted a response under part 18 or they would ask the court to throw it out. I was ready to give up until i saw a templete response letter on here to send them. Apparently its just scare tactics. I have now responded today and am awaiting the next stage. If they do issue you a defence, don't give up, find the templete letter on here about cpr part 18 (would tell you where it is but am not sure myself now). keep fighting, like you i hvae had no response from natwest at all until the defence dropped through the door.
Hi - for anyone wanting an example of how to respond to the CPR18 request, this is what I wrote to Cobbetts. Obviously, you'll need to substitute your own particular details, but I wanted Cobbetts to also be clear that I had previously supplied details of charges.

I am not prepared at this stage to answer the CPR Part 18 Request. I anticipate that the claim will be allocated to the small claims track and would not then expect to have to deal with a Part 18 request since these are specifically excluded under Part 27 unless the court specifically orders me to do so of its own initiative. <O:p</O:p
I am somewhat surprised that you have requested the information outlined in 2.1 of the ‘Request for further information and clarification’, since this information – in the form of a Microsoft Excel spreadsheet - was sent to National Westminster Bank PLC on xx March by recorded / ‘signed for’ delivery, and I have proof that this letter was signed for. Additionally, this same information was sent to MCOL on xx April, with the request that it be attached to the particulars of my claim. It does somewhat concern me that you are dealing with this matter without having all the paperwork from your client, National Westminster Bank PLC.However, for clarity, I enclose a copy of the above mentioned spreadsheet, and confirm the charges I am claiming were applied to the following account:

Right at the last minute on the 14th day of the claim being served to Natwest they have acknowledged it. I honestly thought i would be putting in a judgement by default tomorrow as I haven't heard one word from them during this process, yet they jump up for this. :mad:
It's pretty typical of the banks to do this - they're just stallling for time. Be prepared for them to enter a defence and for their solicitors to request further information from you. See my post above, as this information might apply to you.

I don't think there's a hard and fast rule: they often put in a defence, but sometimes don't get around to doing so in which case you can get your judgement by default. It's a bit of a waiting game to see which way they go - in my case, I got a letter off Cobbetts 2 days after they acknowledged, with the CPR18 plus a copy of their defence. Don't be put off by any legal mumbo jumbo that Cobbetts send you!

hi all. bit of advice neede please.
sent requests for 3 accounts at the end of March. Received a full offer for one of them on Saturday. still awaiting offers for the other 2. Last week sent them a final letter asking for a response to all in 7 days.... if not court.
Question is.... i just get a feeling that i won't get an offer on the other 2 accounts. If i don't then it's off to the court we go..... But, can i claim for all 3 and get my interest also on the account they have alrwady offered....??

I echo this .No hard and fast rule . It is all very hit and miss. I followed template and Martin's procedure. Zilch response in 2 -3 months. Then only hours prior to hitting the judgement button,they filed a defence Then on the same day I had two letters -One the defence and solictor's letter from Cobetts and one an offer. Then I rang a week later to be told that they had not received my acceptance -No record on the system -it could take weeks!!
Then on the Saturday ( which must have been inputted on the friday) I received/spotted on the internet mypayout ,in my account !!0 -

How rude are Natwest!!
They had until today to defend my claim on MCOL and did it at the very last minute. Very sneaky!
And waiting for me at home after work was a nice fat letter from Cobbetts, full of big words and legal jargon.

Is this all you sent back to Cobbetts when they filed a defence? And did you send it to the court also?
I've received a defence back from Cobbetts so i'm just working on the next steps now. Any idea of the timescale now?

Hi well i have now received both offers (2accounts)from natwest 1st offer claiming £1134incl interest Natwests offer £1015 which ive accepted
2nd offer claiming £2183incl interest Natwests offer £1792 Total chgs are £1843 cant understand why??? can anyone else One offer is for full amount of chgs yet 2nd offer is not can anyone shed light on this would appreciate some help0
