I have had no response to my thread asking for help.
I have received a defense fron NATWEST saying that "The defendant is embarassed by lack of particularity pleaded in the claim".
Im assuming this means i now need to forward on a letter to them detailing my evidence for making the initial claim?
Is there somewhere i can find what i do next, or can someone help me asap.
I would very much appreciate it if someone can pont me in the right direction.
The deadline is Friday to respond.
Thanks0 -
As i have received nothing from my local court as of yet asking for any information, and Natwest have give me until Friday to respond to their defense. I am panicking a little as i dont want my case thrown out after spending £120.0

Another success guys...wanted to post it here because this is where I got all my help!
First letter posted 26 March.
Second letter posted two weeks later.
Both recorded delivery and both to branch + head office.
Rec'd offer 1 day short of the 8 weeks which I refused.
Phoned again because had other issues with my branch. They reviewed my case immediately. They would not pay interest. They knocked off charges they thought were not applicable and also refused the 2 years that went over the 'permitted' 6.
I rec'd a revised offer on Friday 1st June. Returned it recorded delivery immediately.
RECEIVED FULL PAYMENT TODAY!
For the Natwest employees monitoring this site, as previously stated, my freedom of speech remains intact as does my ability to take this case further. I signed my acceptance 'Without prejudice' and my reserved rights are about to be implemented!!
Also, as previously stated, this was never about money (although I am delighted to have it now), the banks need to be punished.
GORDON BROWN ought to be crucified for allowing this to happen and continue happening.
As for NATWEST paperwork in future...I will file it under 'F' for buckit! (sic).
Well Done U! Another success story!
I too received my letter and posted it back recorded just incase just checked my bank and my money has gone in today! :j
Not impressed though as they have just slapped another 2 charges onto my account on the 4th June! Why couldnt they just have wrote them off seeing as if they were abit quicker at putting the money in my account i wouldnt have gone overdrawn in the first place!

Hi all,
I successfully claimed charges from NatWest credit card. Well, I accepted their offer to refund me the difference between the original charge and £12.
As that account has a default registered against it, I was wondering if it would be at all possible to argue that it was a direct product of the charges and have it removed?
Has anyone done anything like that?

hi everyone, sucess today, recieved my offer letter:j :T :j , signed and posted back within ten minutes of getting it, sent my first letter on 29 march, got to threatening court action stage quite a few phonecalls recieving verbal offers and being asked to wait 8 weeks which i did and it arrived today on their last day, id like to say thanks to everyone on here you are all great and keep at it you will get their in the end, special thanks to frugalpam good luck with yours i know it is taking a while now.
the only thing im worried about is that mine is a joint account although all corresspondance does come only to me with just my name on it as my departed has gone back to jamaica, and on the slip you sign there is a bit where both sign if a joint account but there has been no mention of him througout this case, anyway we will soon see!!0 -
Hello everyone, just a quick update and some good news!
I sent 1st letter to Nastywest on 16 May asking for £3001.00 puls interest of £866.42 - a total of £4167.42.
I hand delivered to my own branch.
I followed this up with a phone call to Customer Relations 7 days later to check if they received letter, which they denied it had been forwarded. The lady i spoke with called Jane, advised me to send copy via email which i did the same day, and on 25 May i received this reply:
Thank you for your email.
I have passed your email to the department that deals with complaints about
charges.
They will contact you directly about this within 56 days. This is in
accordance with FSA guidelines.
I stuck to the timetable that Martin advised and 14 days after the first letter was sent (30 May) wrote again using letter 2 and advised would give them a further 14 days before court action. Again, hand delivered to local branch.
This week on Monday i received a letter from Cust Relations telling me that they were considdering my claim and given the work involved, they would respond within 6-7 weeks or sooner if possible. This letter was not even addressed correctly. It was addressed to the first letter of my surname and then my forename! I presume this is a delaying tactic so further down the line they may stall to change name!
I called them this morning to advise had received a letter and was sent to incorrect name. The girl i spoke with was very apologetic and advised to sign the letter and write correct name on it, and she would change details on system to correct ones.
I advised that there was nowhere to sign, which she seemed suprised. She thought it was an offer letter.
This is the point where i asked her if there had been an offer, to which she said yes - of £3301.00 (the amount i was claiming before interest), and she advised me that i would receive it by next Friday!!!
Hopefully this will arrive before then as if dont hear by next Friday it will be 15days since the 2nd letter was sent and i shall then arrange the next step via MCOL.
So, sometimes, it does pay to call, just remember to be extremly polite and looks like things may get sped up! The number i called was 0800 015 4212 option 1 then option 1 again.
A big thank you to everyone who has emailed their experiences, as without you guys - and Martin, i wouldnt have had the bottle to do it all - and to anyone starting out, it really does work, just follow Martins guidlines and stick to dates and you will succeed!
ps. i will be accepting the offer - who wouldnt!!!0
