    Hi everyone,

    I really need some help, as Im not sure as to what to do next, I received a letter from the court a few days ago, and I thought it would be an Allocation Questionaire, but instead I received this

    Does anyone know if I have to do anything, because Im assumin this is just for my records, and also, does anyone know why I havent received an Allocation Questionaire, has anybody else received this letter I got?

    Any help will be greatly appreciated, Thanks!

    Hello everyone! I have a couple of questions that I can't seem to find a clear answer to, so I was hoping I could get some help from you pros!

    First of all, it might all be a little too late as hubby and I have filed with the moneyclaim site. We're claiming back £1525 from HSBC.

    Now for the questions:

    1. I've seen a lot of question about whether or not HSBC's "notified fees/charges" can be claimed back. I read in their T&C's that they'll charge you if you go over your overdraft with interest. We haven't claimed back the interest charges, as is my understanding, but we did claim for the charges. Is this okay?

    2. Also, I don't know if we'd read some different information or we're just being incredibly unfair, but we only gave 2 weeks from the 2nd letter to going to court. Will this be viewed as unreasonable? I've seen a lot of other posts where people talk about giving 8 weeks...are we just being hardcore?

    3. I can't seem to find information about what happens now. I know this is another waiting game, but how long does the bank have to present a defense? And is there an amount of time they have in which to pay (should we win, of course) before the whole bailiffs issue comes into play?

    Again, I apologise as I'm sure I've repeated questions. There's a lot of information to digest here and loads of different banks and creditors to contend with and I just wanted to be clear. Thank you for any help you can offer and good luck to everyone in our boat!

    1. No you can't claim interest charges, but can claim notified fees/charges
    2. Its up to you how you wanted to proceed with timescales. A lot of people are now sitting tight for 8 weeks with HSBC as they tend to be giving an offer around this time. There are so many people claiming through courts now, that sometimes waiting the 8 weeks turns out to be the quicker option. You can't claim interest waiting the 8 week route though. However if you aren't happy after this time, you can refer to the FO (which is free), which you can't do after only 2 weeks
    3. Sorry can't help, i'm approaching my 8 week mark


    As an update on my claim, I sent a message through e banking explaining i'd been told to contact during the last week, and I'd been charged a further £50 last month, and have £39 to come this month. I received a reply that they were sorry for the delay, it was being looked into, and she had added the £89 to my claim. I'll give it a couple of days before ringing. I'm not actually sure what day my letter was loaded onto the system. A bit bizarre that both internal e banking messages were from the same person, or maybe they all have the same customer service persons name on them?

    Hi all.

    I spoke to HSBC yesterday as their legally entitled period ends today.

    After a lot of huffing and puffing, I was told that an offer letter is in their system and will go out yesterday or today.

    I had a moan and said I WANT MY OFFER LETTER TOMORROW (today). As its the last day they have to respond.

    She said it will go out and may take up to 5 days to arrive.

    Can they do this? I suppose they can, but she said it has to go through internal systems, its not like just sending a normal letter.

    Surely if today is their last day, then i should receive an ANSWER by today?

    Can someone please confirm.

    As you can see by the above posts HSBC will reply in due time so not much point in huffing and puffing over a day or so!

    Yes there is, thats the point, LEGALLY their time is up, so why should I wait another day??

    God knows they wouldnt give ME another day if I was overdrawn!!!

    I too had exactly the same through the post and am looking for some advice on this, no AQ, just a copy of the defence from HSBC?
