You can't claim back the interest on a loan as the interest is calculated over the duration of the loan.0 -

I am still confused about the England / Scotland difference and the "local" court.
I have an account in an RBS branch in Scotland but I have been leaving in England for the past 6 years.
1- Which rule applies for me the Engalnd one or the Scottish one?
2- If it comes to taking the bank to a small claim court, where would that be? local to me (in Engalnd) or local to my branch (in Scotland?)????

Hi new to this forum.

started inital claim Friday23rd Febraury 2007
got letter today saying thanks for getting in touch but can't agree to your claim.
They say they are always there to help but when we needed help they didn't want to know.
Writing back to tell them we are starting court proceedings.
As we are always using our overdraft and yes sometimes going over that - we are worried that we aren't allegible to claim in court. Can anyone advised us?

As you live in England you go by the English court which means you can use MoneyClaim online, big advantage. When/if it comes to court you put in your local court to where you live.
The registered address for RBS is in Scotland so you also have to ensure that you put in MoneyClaim (should it come to this) a main branch address for RBS in London say as it won't accept the Scottish registered address.0 -
Hi I'm new to this and couldn't work out how to post a new thread. I sent £10 along with the 1st letter template asking for the past 6 years statements and the Halifax sent only mid august to Dec 06, can they do this?Halifax credit card £5700 D
Halifax Current acc £1000 D

I am confused as to whether i even have to send off for my statements for the last six years. I have statements for perhaps the last one and a half years and am only really interested in reclaiming from these. I have no interest in waiting a month to get all my statements, because also i am certain that i have not really incurred any charges past the 04 year(probably the 05 year of which i have no statements in my possession, but i am not worried about reclaiming from charges in that year).
I am just happy reclaiming from the last year or so, which is a relativley small sum. Is the dpa thing some sort of pre-requisite or can i just go straight to the reclaim letter?0 -

I'm new to this forum but started claiming charges back after seeing Martins programme on the tv. I claimed back all my charges from RBS, cheers MSE, and recently set about getting my money back from Barclaycard.
I just received a reply from them today and they have said they will pay me the difference between the amount I have paid and some recommendation in a report that said it should be £12.00.
Can they do this, I didn't think the ruling was until April?

I think I will challenge this, but what I'm wondering is, if this ruling isn't until April and its only 2 march now surely I could get my claim in before they could defend this in court?0
