    Have they taken more than 40 days to respond to you over the list/statements? If so read this thread and you need to complain strongly to Lloyds and the IC. You can't estimate your charges as you need to send a list with your claim.

  • Hi, have sent off the second letter today claiming £1507 in charges, haven't calculated the interest though, can i claim that later?

    I am sorry if this has been asked before, I have looked but can't find an answer anywhere.

    I have today received the AQ from the court, and have read the guidance on filling it in. However, Lloyds' defence is based on "they are not penalty charges, they are fees for a service" they even state "There is no breach of contract; the charge cannot therefore be a penalty, consequently there is no requirement that the charge be a pre-estimate of the bank's loss"

    The guide for filling in Section G of the AQ is based on breaches of contract and costs incurred by the bank etc so is this still relevant in light of their defence or is there something else I can use based on their so-called services? :confused:

    Hi. We sent Lloyds the 2nd letter and received a v. patronising reply offering £750 as a gesture of goodwill (we are claiming over £2,000 excl interest). Were just preparing online court documents, when we spotted other people saying their accounts had been credited with these gestures without their knowledge. We've checked our bank account today and the £750 has been credited.:mad: We do not want to accept this as full and final settlement, so are looking for guidance on the next letter to send. Also, do we even need to send another letter? Can we go straight to court and if yes, do we need to mention the £750 in our documents?

    Any assistance, copy letters, personal experience would be appreciated.

    You need to write to Lloyds and tell them you accept this in part payment and without prejudice but will be continuing to court for the rest. You need to take the £750 off your claim before filling in at MCOL.
  • 27th Feb I delivered SAR by hand, to local Lloyds branch. To date the cheque enclosed has not been cashed and no communication has benn received. So toady I faxed them insisting they confirm receipt and could they call me on my mobile to do so. No response. I know it;s a delay tactic. what advice can anyone give.
  • lloyds are driving me absolutely nuts - 3 letters and I havnt even had the charges/statements sent to me yet!

    1. Standard template letter requesting charges with 40 day limit
    replied in 8 days: we are sorry to hear about your complaint, will investigate
    2. letter stating that i did not make a complaint, please send my info
    reply no. 2: we are sorry to hear about your complaint, will investigate
    3. said once again did not make a complaint, just requesting my info under data protection act. used lots of bullet points/bold font and quite patronising tone - reminded them of when 40 days would be up, after which i will contact I.C.

    40 days runs out on 10th march. hope they get a move on - have baby due on 28th april plus partner and toddler to look after - if they delay too long it may well pay off as ill have my hands full elsewhere.

    heres my most recent letter to them - i must admit i'm quite proud of it:

    I have just received your second letter regarding my ‘complaint’ detailed in my letter to you dated 29th January 2007. Once again I am writing back to say that I did not lodge a complaint, I simply asked for a fully comprehensive list of all the default charges for direct debits, unauthorised overdrafts and standing orders I have paid over the last three years. If you cannot provide this information full copies of my statements going back three years will suffice. This is the third time I have asked for this information, and I would like to remind you that Lloyds TSB is obliged to provide me with this information at my request under the Data Protection Act. With my original letter I included a cheque for the maximum statutory charge of £10.00 for providing this information. As it has not been returned I assume it is still in your possession.
    The 40 day deadline given in my first letter will expire on the 10th March 2007. If I have not received my information by this date I will promptly contact the Financial Ombudsman Service, and at this point my request will become a complaint.
    I would like to take this opportunity to express my disappointment at your handling of this simple request, as it is apparent from your responses that you are either not reading my letters or are not paying any attention to the content, and are sending me generic responses which do not coincide with what I have asked.
    I look forward to receiving a coherent response from you within the next 10 days.

    Carry on with your deadlines. They are probably snowed under with claims at the moment. With your next letter send it by recorded delivery though as you can then use this as evidence if it ever gets to the court stage.
