  • I am in the process of claiming back from Lloyds TSB. I made a claim but have just received a letter - The bank are filing a defence against my claim. I know that Martin says this is nothing to be concerned about but I would welcome any feedback from someone who has been in the same situation.

    What is my next step???

    Sent various letters to LTSB asking for my money back each time and the replys i have are as follows 1st reply on 29th March 2006. 2nd reply on 30th May, 3rd reply on 9th August 2006. All of which say that the will not refund any fees as these fees are applied in agreement with the T&C's.

    I then wrote to the FOS to which i had replys on 3rd Aug, 1st Sept, 29th Sept, 25th Oct, 20th Nov, 18th Dec. The replys were all saying they are too busy to deal with my complaint at the moment, which was fine.

    I then got my final reply from FOS 4th Jan 2007, saying that LTSB had offered £170 refund when i have put in a claim for £701.00. So i refused this. They state in the letter that £170 is all that is due, put thats crap as i have statements proving that the figure is way more.

    I wrote my final letter to LTSB to which i got a reply on 14th Feb 2007, after i said i was taking them to court. They said they would not be refunding me any more money.

    As they are saying that from Jan 2003 the only fees applied were to a total of £170.00 but i have a total of £350+ intrest.

    There is another £350 beofore this date. Im in a bit of a pickle as to what do i do next? Shall i take them to court of try with another letter?

  • Hi, ive had a savings account with yorkshire bank for about a year and half now. I have been charged £35 several times since having the account and have always paid. I logged into ineternet banking yesterday to see i had £105 bank charges, i called them to find out why and it was because paypal had taken £8.99 which was fine but they kept trying to take it again several times which they shouldn't have. I was told by 3 different people from yokshire bank that they would cancel this direct debit and refund me all the money. suprise suprise i check today and they hadn't refunded me or cancelled DD so again was lumped with another £35 charge, to add to this i had my benefits of £44 paid in this morning and they took it straight away and have said until this is sorted they will continue to take my benefits and keep adding charges, even though they have addmitted it is not my fault. I have heard that yorkshire bank is the hardest to reclaim from so i dont know what to do, should i just shut up and pay up or take this further?

    Does anybody have any telephone numbers for Lloyds so I can contact them regarding the letters I have sent?

    I have tried all the numbers on the letterheads they have replied with and none of them work...

    I don't know if it is worth trying the general number but I suppose I will give it a go.:mad:

    They sre not allowed to take charges out of benefits (BY LAW) so if was you i would ring them back and say you now know they can not offset any charges against your benefit as this a minimum the government say you need to live on .

    The Direct Debit Guarantee states :

    'If an error is made by the organisation or your bank or building society, you are guaranteed a full and immediate refund from your branch of the amount paid.'

    I would ring and remind them of their obligations and your rights under this guarantee. Ive got you the link to the guarantee and hope it helps, good luck :)

    Further I would contact your benefits agency and advise them of the situation. What the bank is doing in taking benefits is wrong on so many levels and perhaps they can arrange payment by another method for the meantime.
  • Hi, thanks for the replies. My partner said it cant be legal for them to take my benefits. I rang them 3 times yesterday and once today and they just say someone from there investigation team will call back, but noone has. I phoned to let the benefit agency know what was happening and they are paying me by giro but will only do this for 2 weeks. I think im am just going to keep ringing them till they get fed up of me and pull there finger out

    It might be an idea to open another account and have done with this one, at least with regard to benefit payment. Put it in writing to the benfits agency that under no circumstances is benefit to paid into this account, it is effectively frozen for all transactions and is in dispute, hand deliver it if you have to !

    It took me two weeks to set up an account and provide an account number when mandatory payment of benefits into a bank account came into effect. It may seem like a hassle and I am sure it will all sort itself out in the end but the priority is your living expenses. It is essential you do everything you can immediately to keep the banks hands of your money you need it to live on. The benefits agency should extend their two week deadline on this basis.
