yes you can. just amend the sample pleadings to read:
"Between XXXX and XXXX, Claimant was a customer of Defendant Bank."
Rather than "The Claimant is a customer of Defendant Bank"0 -
I have sued before in the small claims "court" and ignored court directions without any problem. I wouldn't like to express my view about the judge who made the order below ....family_life wrote:anyone with some advice please step forward!!
I am in the process of taking Lloyds to court and have at present gone through all of the procedures for reclaiming what is rightfully mine. I shall now cut to the chase. On Friday I received through the post from the courts stating the following.
1/. The parties shall by 4pm on the 6th Dcember 2006 send to each other statements of the evidence of any witnesses of fact they intend relying upon at the trial of this matter and shall append to those statemnets any documents they intend relying ipon.
>>> THIS IS JUST WITNESS STATEMENTS - I.E. A WITNESS STATEMENT FROM THE BANK ACCOUNT HOLDER SETTING OUT ALL RELEVANT INFORMATION.
2/. The parties shall co-operate to prepare a bundle of documents for use at the trial such bundle to include statements referred to above.
>>> WHAT AN ABSURD ORDER. BANKS DO NOT CO-OPERATE, THEY OBFUSCATE.
3/. Each party shall prepare a skeleton argument and that shall be included in the bundle reffered to above.
>>> SKELETON ARGUMENT JUST MEANS THAT THE ARGUMENTS YOU INTEND TO MAKE AS TO LAW SHOULD BE IN SKELETON OR BULLETIN POINT (NOT LITTERALLY) FORMAT AND EXPLAIN WHY YOU SAY BANK CHARGES ARE ILLEGAL.
4/. The claimant shall lodge a copy of the bundle at court by 8th january 2007 and upon lodging of the trial bundle the court will consider the listing of the matter.

5/. the parties should note that the reference to statements includes the statements of the parties themselves as well as any other witnesses they intend calling and that the judge may decide not to take into account any documents or evidence not served and lodged as directed above.

6/. the matter be allocated to the small claims track and listed on a date to be fixed by the court.

i have decided to right excatly what is in front of me because if i am honest I really have no clue on what any of this means. I will be eternally gratefull if someone out there can make this a bit simpliar for me. Basically I'm thick. lol.

They replied in a couple of days to mine, but I know some people have not received a reply at all. Give them 14 days then start the Court claim whether they have replied or not.

If my mum-in-law, claims back her charges, about £500, will the bank use this to pay off the money she still owes them?
Sorry it is so long, as we get bits and pieces of information from her, because she is ashamed of how much she is in debt.
My mum-in-law, owes about £2000, to Lloyds TSB. She got into debt, in my opinion, because the bank offered her a loan (70 years old at the time) to pay off a credit card. When she has missed a payment, she has been charged,£30 a time, and was paying off so much interest, that very little was coming off the debt. She struggled to pay off £14 a week, and gave up, got help fromm CCS (I think) and now pays £1 a month.
The bank have harrassed her, Phoning her up to 3 times a day, she has now changed her number.0 -
I spoke to my TSB to get the address for requesting statements and was told that I'd be charged for them. According to this site the maximum charge is £10 but the person I spoke to said this was wrong and I'd be charged hourly for the time it takes them to compile them. Is this right?0

What a rotten bunch LTSB can be, that's terrible harrasing her like.
When it gets to the Court claim part, put on your claim that you want payment by cheque. They usually pay it back into your account, but I have heard of people getting cheques.

No this is not right, they are just trying to put you off claiming by the sounds of it.

I am just about to send letters for myself, my husband and our business enquiring about the bank charges we paid on each account.
I have a few questions to ask first though as its all a bit confusing to me, never taken on any big claim like this before!
Do I need a separate letter for each account?
Do I need to enclose the £10 fee cheque for each account or will 1 cheque cover them all?
Who are the cheques payable to?
Where do I send the letter/s? as there are many different adresses on the websites.
We are paying back a loan to Lloyds for charges I believe we should not have been charged as customers. They took our un-agreed overdrafts and consolidated them and gave us a refinance loan as we owed (pure bank charges) £6,716.16p we have to pay £46.64 a month over 144 months (thats 12 years!!) :eek:
The APR is 1% and we have so far paid 18 months worth (£839.52p) and still owe £5,533.02) with another 126 months left to go (thats 10 1/2 years still)!!!! :eek:
Will we still be able to make a claim for bank charges refund in our case?
Does anyone know of a building society that has a very low business start up deposit?
We are no longer customers of Lloyds and moved to Barclays a few years ago but Lloyds forced us to take out a refinance loan to pay off our debt of their bank charges as we were ovewrdrawn with 2 or 3 accounts and being heavily charged as even before we went overdrawn with a good customer report they refused to agree an overdraft for us. Even after we responsibly made an appointment and saw our business manager (as even personal account dealings had to be seen by a business advisor) and told him we knew at the time that within 2 weeks we would temporarily go overdrawn by £200 so requested a temporary overdraft of £250 for the month to allow funds to 'clear and catch up' and this was refused. As it happend we only went overdrawn by £50 but it spiralled from there as they applied more and more charges to the account. :mad:
We will soon be leaving Barclays as well as they have put our business in jepoardy of bankruptsy due to their application of charges for almost astonishingly the same reason as we had for LTSB. It seems whenever wew admit to the bank we are heading for trouble and ask for help theyre waiting to pounce on us and make the situation worse! :mad:

Has anyone else had problems with Lloyds TSB
I am at the stage now where I have sent the court claim, & they have had their 14 days, still no reply from the bank or the court:mad:, do I have to wait another 14 days before I take the next step:rolleyes:?? Just wondered if anyone could enlighten me as my wife can't wait to spend OUR money on the grandkids:eek:
