    Thanks for the reply. The 'Unauthorised Borrowing Fees' are £10.00 each time, but some months I was charged this 'fee' more than once and therefore, collectively they amount to a disproportionate total (£20 total for 2 months & £30 for another). Can I still claim them?
  • The law is unless they can prove the charge is reasonable. It is disproportionate.

    I'm taking my webhost to court for charging me £47 for being late on payments, I asked them to justify it but couldn't explain £47.

    I've received information back from my bank (Lloyds) following my initial letter requesting a breakdown of charges. Rather helpfully, I thought, they haven't sent a stack of statements for me to trawl through, but an actual list of all charges levied since 2001 (which has thrown me a bit, as I thought they'd make life a bit more difficult than that).

    There seem to be 4 or 5 (or even 6) different charge types, and I want to know which of these I am able to claim back.The charge types are as follows:
    1) Account Charges (listed as a 'fee') of £8 each (this particular type of charge stopped in 2002);
    2) Overdraft Usage Fees (listed as a 'charge') of £25 each time (this particular type of charge stopped in 2002);
    3) Overdraft Interest Charges (listed as a 'charge') of varying amounts, presumably depending on the overdraft amount;
    4) Overdraft Excess Fees (listed as a 'charge') - this fee varies from £25-£90 each time it is levied
    5) Unpaid Direct Debit Charges (listed as a 'charge') this charge varies from £30-£216 each time it is levied (this also seems to be indscriminate - no explanation as to why one charge is £30, another is £70, another £175 and another £216 and so on)
    6) Unpaid Loan Charge (listed as a 'charge') of £25 (the loan is a Lloyds loan also)

    I've become very confused as the bank calls some of these 'fees', but next to them, lists them as 'charges'. I've tried to be as clear as possible with the terms used by the bank on the lists I've been sent. The only charges that are listed as actual 'fees' and not 'charges', are the first type: 'Account Charge'; all the others are listed as 'charges'.

    Sorry if this is confusing - hell, I'm confused! :eek: If anyone can enlighten me on this I'd be hugely grateful as it will enable me to proceed with the next stage of calculating interest... What joy!

    First Letter dated: 9 October 06

    Have requested the breakdown of charges and interest over past 6 years and received statements immediately. Wrote to ask for refund and have received a letter today saying:

    " The fees we charge for going over an overdraft limit and for returned payments are not any kind of default penalty, they are fixed standard prices for the service we provide and are fair in these situations"

    I am now proceeding with a court threatening letter, but feel unsure about fighting this alone. I am also worried about any court fees I may encure in the process -

    Please someone tell me to continue with this... £700 is a fortune to me and would very much like to have it refunded!!!

    You're not alone, you can ask any questions you have here and get the information you need.

    When you file a claim, you will need to pay a court fee, but you will get this back.
  • Hi, i have just received a letter from lloyds refusing to pay charges back blah blah blah and they have said this is their final responce...do i still send them the letter informing them i will take them to court, and if so, which court do i name if i am using the on-line one? or, should i just go ahead and file the claim?

    any help much appreciated

    Just send the letter now stating that you will issue a court claim without further notice if they don't settle this matter within the deadline in the letter. You don't need to mention which court you are going to use in the letter.

    I had a LloydsTSB account which is now closed, can i still make a claim does anyone know? One of the reasons I cleared my overdraft and closed the account was because they kept charging loads for silly things. I bet they owe me a fortune.......

    Yes, you can claim on any account whether it is closed or still active.
