    I wrote to LTSB earlier this year, using the letter templates from the consumer site. They replied back within the time frame stating that they disagreed the office of fair trading comments and would not refund charges made for exceeding overdraft facilities and that the matter was closed.

    I have since forwarded my complaint to the ombudsman, who have also been told by LTSB that they will not refund.

    My question is: Should I leave this in the hands of the ombudsman to negotiate with the bank or should I take the court route?

    Any help \ advice from members who have had a similar experience would be greatly appreciated.

    This is a standard reply you got from the bank. Nearly all of them reply with this form of answer at the beginning.

    You shouldn't have contacted the ombudsman. They wont be able to help you.

    How far did you get with the template letters from CAG? Did you just send the first 'preliminary letter' requesting payment of your charges, or did you also send the 'Letter Before Action' giving them two more weeks to pay the money or you would issue court papers?

    If you haven't sent the letter before action. Send it now, then if (likely) they don't reply, or reply with the same answer, you need to issue a claim in your local county court with no further contact to the bank.

    They will drag their feet as much as they can to try to delay paying you the money, but if you follow the process set out on CAG, you will very likely get your money.

  • Has anyone had the problem of being mis-sold a Gold Account with Lloyds. I was when my account manager said that to open this account I had to pay in a salary of £20,000 or greater. It was years later that I queried monthly charges appearing on my bank statement for the second time when I was informed that I needed to maintain a balance of £25,000 pound in my account !! The first time around I was told that I being charged because I was in overdraft.

    Also, I'd never ever earned a salary of £25,000 that so it wouldn't have made sense for any account manager to encourage me to open such an account and for me to keep it going just to pay them bank charges every month. Surely, I'd have better things to do with my money!!

    Anyway, Lloyds refused to acknowledge that they'd mis-sold me this account so I wrote to the Financial Ombudsman, as advised. The Ombudsman said they couldn't take my case further. LLoyds offered to compensate me with £50 as a gesture of goodwill when I believed they owed me at least £400 in charges.

    I thought that I'd gone as far as I could go after the Ombudsman's response. I reluctantly accepted the £50 by spending it but haven't used the account since - which by the way they downgraded for me without my permission. I was in fact going to close my account with them but have left it dormant instaed. And I have never put in writing that I was pleased with the outcome.

    Can anyone tell me if I'm still able to claim these bank charges

    i've written to LLoyds to claim back £600 worth of charges
    i used the template on this site
    they've writted back to me saying that they are sorry to hear i'm unhappy, and basically if i want to take any further action i should contact the financial ombudsman..
    should i just continue the process and send the courth threat letter??

    please help, i'm unsure of what to do

    I have received details of all bank charges for the last 6 years, and have used the interest calculator on this site.
    Do I make a claim for the total costs? ie. my charges plus interest?
    Or do I have to make any adjustments ie. how much do they charge to send a standard letter?

    I'm sure this is so easy, I guess I'm just afraid of making a silly mistake.

    CANDY101, calculate the total amount of charges, but do not include the 8% APR interest until you get to the stage of filing a claim. This can only be added when you take them to court. Don't deduct anything (I guess you're referring to the £12 OFT 'reasonable charge'). You should be able to get the whole lot back.

    winaw1 - Ignore anything the bank say unless it's offer of a full and unconditional settlement. Continue with your timetable and send the next letter.
  • i would also be very interested as i have been trying to claim charges off of them as well, and as far i have read they are the most difficult bank to payout. but i am not letting that stop me, i am looking it up and am going to ring the CAB and see if they can offer any help. OP that letter is a standard letter as i have had two exactly the same with different dates on them, and they were both signed by jamie o'neill

  • I've filed my claim and received the Acknowledgement from the County Court and Lloyds now have 28 days to file a defense, but they are defending all of my claim, so I guess its just a matter of waiting now until I hear from Lloyds solicitors!

    And I was hoping I'd get my money for Christmas!!!

    Do do I just wait now for Lloyds TSB solicitors to respond?
