  • anyone with some advice please step forward!!

I am in the process of taking Lloyds to court and have at present gone through all of the procedures for reclaiming what is rightfully mine. I shall now cut to the chase. On Friday I received through the post from the courts stating the following.

1/. The parties shall by 4pm on the 6th Dcember 2006 send to each other statements of the evidence of any witnesses of fact they intend relying upon at the trial of this matter and shall append to those statemnets any documents they intend relying ipon.

2/. The parties shall co-operate to prepare a bundle of documents for use at the trial such bundle to include statements referred to above.

3/. Each party shall prepare a skeleton argument and that shall be included in the bundle reffered to above.

4/. The claimant shall lodge a copy of the bundle at court by 8th january 2007 and upon lodging of the trial bundle the court will consider the listing of the matter.

5/. the parties should note that the reference to statements includes the statements of the parties themselves as well as any other witnesses they intend calling and that the judge may decide not to take into account any documents or evidence not served and lodged as directed above.

6/. the matter be allocated to the small claims track and listed on a date to be fixed by the court.

i have decided to right excatly what is in front of me because if i am honest I really have no clue on what any of this means. I will be eternally gratefull if someone out there can make this a bit simpliar for me. Basically I'm thick. lol.

    Many thanks.

Must admit I'm starting to worry a bit now as it all seems rather formal.

    many thanks to any helpers.

  • Hi everyone,

I am new to all this, a total charge claiming virgin!!! But I think now after reading all your chat that I may have the balls to take on the big boys and go for the gold! Ta!

I calculated today that Lloyds owes me 2090.00 for 2 accounts worth of charges since 2004! (I'm sure it's no coincidence that my total overdraft balance is 2100.00!) If I win I think I can cope with paying the £10 difference to clear the overdraft!! I had the statements already so am going straight in with the letter asking for a refund....am I right in sending it to the Lloyds registered address in London????

Me and him indoors are also gonna claim from Halifax, we dont have all the statements but this year alone we've been charged 697.00 and weve had the account for 2002 so I can only imagine what the total will be.....it's a flamin disgrace!!

Am also thinkin about claiming from my credit cards and loan....there'll be no stoppin me now!

Any recommendations for any banks that I could open a new account with????

Cheers for the advice and all, I'll keep ye all posted

    xxx
  • Hi there, after years of being an unhappy Lloyds TSB customer (and having been charged through the roof unfairly on many occasions) I decided enough was enough and moved to HSBC who have been brilliant.
I closed my account with Lloyds a month ago but now I want to claim back any charges I feel were unfair.

Do I still have the right to do that as I am not an existing customer?

    Any help would be great!
  • Hi can anyone tell me if i can still reclaim my charges from lloydstsb - i was a customer for 8yrs but closed my account down a couple of months ago because they were so unhelpful with mine and my partner loan application. I stil have my account details but don't know if i can still do this as my account has been closed down! THANKS char
  • Buoyed by everything I've read on the internet and this excellent site, I'm about to reclaim my bank charges on two of my accounts.
I've already exchanged letters with Lloyds' Customer Recovery Centre. Do you think I'd be better off sending my official Step 1 letter (with my cheque for a tenner for my list of their charges) to my branch, or their Recovery centre?
  • I'm all fired up & ready to take on LloydsTSB - are they likely to close my accounts? I have overdrafts with them, are these affected? Be good to hear other peoples experiences, so I know exactly what to expect!

The Reclaim Bank Charges Resource Bar <table style="border: 1px solid rgb(0, 0, 0);" _base_target="_blank" cellpadding="2" width="100%"> <tbody _base_target="_blank"><tr _base_target="_blank"> </tr> <tr _base_target="_blank"><td style="color: black; font-family: Verdana; font-size: 9pt;" _base_target="_blank"> Step-by-step Guide: Reclaim Unfair Bank Charges Calculator: Charge them interest Template Letters: (right click and save) Ask for charge details, Initial letter, Second letter, Small claims note Article: Top New Bank Account</td> </tr> </tbody></table>
Yes, you can claim on closed accounts, you can send your Data protection letter to your branch or the address given in the address sticky thread here.
  • Hello everyone,

It's my first post on here, I've been reading this web site for about 18 months and have been following the unfolding story of bank charges. Now I have never had a bank charge in my life and to my horror I have come home to a letter from Lloyds telling me they're charging me for putting a payment of fifty pounds through to a friend when the cheque in my account hasn't cleared (the cheque is for over five hundred pounds!).

What really annoys about this is that the cheque was payed in Monday morning and should take 4 days to clear. Monday evening my internet banking tells me I have over five hundred pounds in my account and allows me to transfer the fifty pounds (which incidentally should clear after the cheque has cleared!).

I think nothing of it as it allowed me transfer the funds, and then come home to the letter this evening! The letter even has the cheek to say "We appreciate that your account balance appears to be in credit but the funds are not yet available for you to use"!

After reading the current account article on here I have recently moved to Lloyds from HSBC, so I am furious that they have done this, especially as I am a new customer.

I have read Martin's article on bank charges and will call them tomorrow as it is the first time it has happend and see if they will refund the charge.

Sorry for the rant, I'm just furious and wanted to share the complete lack of customer focus Llloyds TSB have with you all!!!

    Regards

    Flav8
  • For the two users asking about closed accounts the answer is yes you can claim on closed accounts.

flav8, its always worth phoning them to ask for a refund especially if this is a one off charge.
  • hi everyone can i claim back my bank charges if i have allready closed the account 12 months ago. cheers
