    After reading through all the success stories I've noticed that no one seems to have claimed charges back from Y Bank. If anyone has I would be interested to know. Currently changing bank account and about to send first letter to Y Bank.

  • Finally got my money back yesterday! over £2000 straight into my account, although it did take since June. The case was due in court next week, so if they threaten you with court, don't worry, just do what you're asked to, and sit back and wait for the money. Thanks to everybody who helped out, I'll make sure I keep looking in to offer any advice I can.:beer:

    I'll try and condense the story into something that makes a little sense!

    Back in September '05 my partner was overdrawn by about £5.

    He paid the charge of £30 for this.

    After stumbling across this site we decided to write Lloyds TSB a letter regarding this charge in January '07.

    This is the part I need advice on...

    Every month Sky Digital take £34 from his account via direct debit. Admittedly, on a few occasions he hasn't had the money in the account but has always put money in on the same day to sort it out. He was told that if this is done before 3pm on the same day the account has become overdrawn, there will be no charges.

    This month (Feb 07), however, things changed... #Sound of thunder and lightning#

    Lloyds declined the direct debit. I assume this is because of the letter he had sent to them in January voicing his anger at the charges. He has not received any correspondence stating they would no longer allow money to come out if funds were not there. We can only assume it was the letter that caused the direct debit issue.

    Last week he received a letter stating there was a returned direct debit charge of £35 to be taken in early to middle March.

    What are peoples thoughts on this? :confused:

    Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.

    Like any business, we do make a charge for some of our extra services. When customers don’t have enough in their accounts to cover a payment, this always means extra work – and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customer we can’t agree it. We feel it’s fair to charge for this service.

    Of course it’s only fair too, that we’re completely open about any charged-for-services before you take them up. That’s why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.

    Just as importantly, we do everything we can to help our customers avoid these charges altogether. I’m sure you’ll know how easy it is to keep a running check on how much is in your account. You’re free to get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we’ve agreed. You’re welcome to see if we can raise it – and e usually give you an answer straight away. Again we can do that for you by phone, on line or at any of our branches.

    You’ve mentioned the new guidelines from the Office of Fair Trading on credit card default charges. We don’t agree with the OFT’s thinking on this and we’re still talking it through with them. But the important point is that the guidelines are about ‘default’ charges that people pay when they break an agreement with us. The fees we charge for dealing with your request to go over your agreed overdraft limit are not default charges because you haven’t broken your agreement. They are our prices for the service we provide in these situations.

    I do hope you can see that we make our charging system as fair as possible – and why I can’t agree to cancel your charges.

    Please let me know if there is anything else I can do. If we cannot come to an agreed solution after this I will help you refer your complaint to the Financial Ombudsman Service for independent advice.

    If you are happy with the way I have dealt with your complaint, there is no need to reply to my letter. If I have not heard back for you by the 12/04/2007, I will close my file, thought I will be happy to reopen it should you come back at any point afterwards.

    No idea but note they are only referring to "a charge for dealing with your request to go over your agreed overdraft limit".

    Did you make a request to over your agreed overdraft limit or did you go over your agreed overdraft limit without asking?


    If you asked then they are saying you accepted the charges they apply.

    If you went over your agreed overdraft limit without asking then would that be a default charge?

    I had exactly the same letter this morning from Lloyds TSB minus the paragraph about the OFT because I didn't mention this in my letter claiming charges. I came on here to ask the same thing so thank you for confirming what I thought - that it is just a standard letter. So it's onto the next letter for us...:T
  • I was shocked (to say the least) to receive a letter on saturday from Lloyds TSB to say that as from March they would be charging a £35 a year annual fee for my credit card. I was so annoyed that I phoned straight away and cancelled my card.

    Has anyone else had this letter and is it just Lloyds or are other banks going to be doing the same::eek:

    Many thanks in advance for any help with my query.

    To cut a long story short -

    After reading the advice on this site i decided to try and re-claim the last 6 years bank charges (£120+ interest) from my bank Lloyds TSB.

    I wrote to them - they fobbed me off and told me they would not pay me back.
    I wrote to them again as advised threatening legal action after 14 days. - I heard nothing from them so filed the claim online with the court - at a cost of £30 to me.

    3 days later they wrote to me and said as a gesture of goodwill they would re-imburse me the £120 (but stressed they had done nothing wrong). They did not mention or offer interest. They automatically transferred this £120 into my bank account.

    Now today i have had a letter from the court telling me that lloyds have submitted a defence and sent me the paperwork to respond.

    My question is - Do i respond to try and recover the interest and £30 court fee (£70 in total)?
    Can lloyds try and defend the claim when they have already partially paid out? and if they do will they actually take it to court?
    Should i just bite the bullet and be happy with my £120?

    Please help!!
