  • Please can someone offer me some advice, I have bank charges to reclaim from lloyds tsb amounting to £2583.00, I have followed the normal process,
    1st letter -
    Response - no way
    2nd letter - threatening court if not paid
    response - they have paid £750.00 (which they say represnts court fees!!) into my account and told me that as far as they are concerned the case is closed and if i want to take it any further i can either go to court or contact the financial obudesmen.

    I have not touched the £750 as I am undecided now as to whether to go ahead with my claim through the court or just to settle with the lower amount.

    My concern is because, if i go to court will they not see that the bank had paid the money to my account and decide against paying the rest????

    I did not offer them a settlement fee in any of my letters or ask them to pay any money into my account, and this seems like a bit of a shove off to keep me quiet!!

    So Do I continue my claim via letter even though they have said the case is closed?
    Do i go to court?
    or, be happy with £750 instead of £2583.00

    Advice and suggestions would be most welcome

    Accept without prejudice, and write and claim the rest.

    It will not go to court.

    Advise you to go to the Lloyds forum (this may be a common tactic - they'll advise you better)

  • Hi All

    Have just calculated the charges applied to 2 accounts I have with Lloyds. 1st is for £5038 plus interest the other is £1334 plus interest. No wonder I have always felt short in the pocket the past few years. Thats over £1000 a year they have sneeked out of my account at source!

    And I am encouraged by the post on this forum, and I will keep you all informed. 14 days and counting!!!
  • I sent the 3rd letter threatening court action around 8 days ago and Lloyds Bank have still not replied, what should I do???
    Please help!
  • apply at moneyclaim time to take the swines to court dont worry they will pay before court date sooner you start this process the quicker u will get your money back.

    Hey Dawn,

    You need to write to the bank with something like.................

    I cannot accept your offer of £750 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.

    You also need to inform the court that part of the claim has been paid, and ammend the amount you are now claiming for.

    Unless of course you're happy to accept £750 instead of £2583. Personally I would continue all the way.

    I've got a couple of questions. Bare with me this is my first time on.

    a) I've got a situation where Lloyds TSB have Acknowledged my claim for £3005 (after i sent a letter whereby they replied saying 'fair charges blah blah blah') but when and if they finally defend this claim, what is the average amount of time it will take to reach the court case if Lloyds are as reluctant to be rolled over as so many of you say??

    Afew dates to help- Last date of acknowledgment allowed- 27th Feb 2007
    Acknowledged claim on 15th Feb

    b) Also, my charges came to around £2200 and I estimated about 8 months worth of charges from back in 2002 totalling £200 of my claim and then the rest I put as interest that I worked out on Martin's calculator. Will I have to justify all costs to the Court??:eek:

    Any advise anyone could give me would be greatly appreciated!! Good luck to everyone by the way!!
  • No idea how long any claim takes as each one is different.

    Yes you will need to list all charges if it goes to court and they may well exclude any estimates.
  • Hi everyone Lloyds Tsb are taking a long time with my statements it's now over the forty days. I have made a lot of phone calls to them do you think it's worth going into the branch??? Or do I just go straight for the ICO??? :confused:
