  • We have started court proceedings to reclaim charges totalling circa £2.7k from Lloyds TSB.

    They have acknowledged the claim, but state that they intend to defend the claim.

    I really dont have the funds to have a long legal fight with a bank, but what do i do???:eek: :eek:
  • There will be a further cost of £100 as they have defended the case but this amount as well as the £120 for filing online will be added to any successful claim.

  • Had a letter in response to my first letter after 6 days. It says "I do hope that you can see that we make our charging system as fair as possible and why I can't agree to cancel your charges" blah, blah, blah. So I phone the number listed on the letter and brought up all my details, and so are not making me an offer. The bloke at the bank then said he is going to get my case re-opened and investigated and that can take 4 weeks. Well this Saturday (24th Feb) is the 14 days up so I will be sending my 2nd letter to them if not resolved!!.

    Does this sound similar to what everyone else has gone through???

    I have just had a letter from lloydstsb saying I have to pay them over £200 in charges for unpaid dd's on the 3rd of jan.....in august I set up a standing order with hsbc to pay a certain amount of money o cover dd's and loan payment to be transfered to tsb at the beginning of the month....why didn't some1 tell me that an electronic transfer does not credit your account immediatly thus covering yourself for such complications....tsb told it is not there fault..I agree and hsbc have told me to write to some1 that gives a dam...I cant afford to pay £200+ in charges and want them stopped b4 they are taken leaving me not enough money to pay march's dd's and loan resulting in a merrygo round effect...please help

  • No bank says that an electronic payment is instantly in your account especially between different banks and therefore the money is not available for use.

    You can try phoning Lloyds, I'll shift this into the Lloyds thread so you can see how people are getting on with them, and quote Martin's letter to them and see if they will stop the charges now. If they don't you then need to send the letter off to them. Please read Martin's article below and also you need to ensure at least 4 days between your transfer and the dd's going out of your account.

    hi im thinking of making a claim on behalf of my partner but im a bit scared about the whole court process, dose anyone have any information of how many claims with lloyds tsb have gone to court, how many have had a defence and how many have lost a claim.
    also how long dose the process usually take with lloyds and have they ever just paid up without the threat of court

    also is it just charges for going overdrawn, or is it for direct debit and bounced cheque charges

    From what I have read on these forums, in some cases (in the minority) Lloyds have paid without threatening court. Most cases people start the MCOL process, then Lloyds either acknowledge or say they will defend then eventually pay up. I am going through the MCOL process at the moment.

    sorry but what is the MCOL process? also do you need to have a lot of time on your hands to do this or is it just a case of sending and recieving letters.

    MCOL is the small claims court process (money claim on line). You dont need a lot of time. Once you've sent the first two letters (templates on this site), you then go online and fill in the bits and pieces (threads in this forum to help you), you then wait and see what the bank does. You can keep checking the MCOL site to see if your bank have acknowledged (gives them more time) or defended. It really is not that time consuming.
