  • After reading many a thread to determine Lloyds resolve, I have a clear understanding that this may go to court.

    I am claiming £1586 inclusive of interest. I sent letter 1 asking for my charges back on the 8th February and received a response yesterday (17th Feb) saying the usual "these charges are fair etc etc".

    First thing in the morning I will be sending the last letter giving them 7 days to respond to my claim. This is my 1st claim and after reading this thread I am fully aware this will go most of the way. I know Lloyds may offer me £750 as good will which is standard for claims above a £1000 but I will never accept such an offer.

    I believe Lloyds to be probably the most stubborn out of the major high street banks and NATWEST are paying up on the letter stages, how easy are they!!!

    My advice to those in a similar positon to me, is don't be affraid to take it all the way and don't become dispondent and impatient. Make sure before you submit your letters you have up to £120 put aside to take Lloyds to court via MONEYCLAIMONLINE. I have a feeling this may be the time people give up the process due to lack of funds or fear.

    This may be why Lloyds go this far as a fair % of claimants forefit thier cliams. FEAR NOT, i have been through this thread with a fine tooth comb which has given me the inspiration and enthusiasm to fight this all the way if needs be,the success rate has been phenominal. Good luck to all, especailly my fellow Lloyds claimants, keep me updated of your progess.

  • In fact there may be further court costs if it goes to trial of £100 for claims of over £1,500.

    Can anybody help me? I have had a claim against LTSB ongoing since june 06, I have now received a letter from the courts telling me that I have to send to the bank dates, ammounts and reasons for the charges, is this normal??

    Yes, you should already have provded a list of the date/what the charge is/amount of the charge/interest for each charge (if you are claiming this). You need to send one copy to the court, and one copy to the banks solicitor.

    If the court asks for anything, you must provide it. If you ignore anything the court asks for, you could have your case thrown out.

  • I have contacted the Halifax bank for statements from 2000-2005 which I have received.I will be putting in a claim for a LARGE amount of bank charges.
    Other than my 5 years statements we have no letters concerning our charges.
    Although to be fair we had 5 years of severe financial problems,all of our creditors did assist,even our mortgage providers.They have now thankfully all be paid and cleared in full.
    Several times over the years I contacted our bank to see if there was any arrangements we could come to-but to no vail the charges just kept coming.Without interest they amount to 15,496.00.
    If anyone requires any information we,like you would be at a loss.

    Two claims to LloydsTSB
    a. £1245.02
    b. £409.61

    These are done separately due to 'A' being my current account and 'B' being an old business account.

    Got to the stage of starting 2 separate claims through MCOL (They were issued on 8/2/07 and the next column on MCOL has a clickable "start" in it)

    I had the standard "it's your fault" letters and haven't heard anything from the bank about the court claim but did receive on the 13th a blah blah letter about the £750 which has also been paid into the account.

    To be honest I am unsure of what position this leaves me in! I have already forked out £120 & £50 for the charges to register the two claims with MCOL.

    I did notice that Edinburghlass said to someone else to write to them and say that I am accepting this as part payment. But I am also confused as to where I am up to with the process of the registration with MCOL. (Which I'm blaming on trying to get my head around this after a very heavy weekend!)

    Not sure whether to be happy or annoyed about the £750! :rolleyes:

    You need to write to the bank with something like.................

    I cannot accept your offer of £750 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.

    You also need to inform the court that part of the claim has been paid, and ammend the amount you are now claiming for.

    Phone the court up and ask their advice. They are very helpful.
