    You're quite right to be looking carefully at this.

    I've just got my cheque from YB after a looong fight. I live in Leeds and served all papers to their HQ at:

    Yorkshire Bank,
    20 Merrion Way,
    Leeds,
    LS2 8NZ.

    They trade on the YB name (nice cuddly image from the days of Yorkshire Penny Bank) but they're actually part of Clydesdale Bank, which as you say is in Glasgow. In turn, Clydesdale is part of the distinctly non-Yorkshire National Australia Group.

    None of this matters to you, you don't need to care less how they choose to organise their business. Just send all your letters, court docs etc. to the Merrion Way address by recorded delivery.

    By the way, Yorkshire/Clydesdale have a reputation for taking these cases right to the wire and trying every trick under the sun so just keep your cool and follow the process diligently.

    A number of us in the Yorkshire area recently had our cases transferred to the Leeds Mercantile Court (more of a big daddy court than the small claims). The idea was that the court service are getting so sick of having these cases come through that they wanted to force a precedent in a "proper" court. Lo and behold, at 7am on the morning before the court session was due to be held I got a recorded delivery cheque.

    If you have any queries regarding what your charges are phone the bank and ask if this is overdraft interest or a penalty charge.
  • Hi, I'm just starting out down this route. I've written to LTSB requesting details of charges, once to head office and once to the data protection address on the main site, as follows

    on both occasions including £10 cheque. neither has been cashed and the second letter sent recorded delivery doesn't appear to have been signed for.
    Is this the standard delaying tactic and what can I do if they wont even send my info through?

    I suggest you phone both addresses you posted your letter to and find out who is dealing with it as there is no point in this work being duplicated and costing you two lots of £10. They do have 40 days in which to produce the information.

    Hi Tiff, I dont want to pay £30 to moneyclaim when theres a chance that Lloyds will pay up without it. In my case, I havent used the Lloyds account for ages and it has an unauthorised overdraft on it of just less than £600. £750 to me at this stage would enable me to pay the overdraft, thus preventing more charges, and close the account - yipee and walkaway from Lloyds. I can then when in a less stressful period (first baby due next week)go the MCOL route to claim the rest. I just thought that the fact they are offering the payments is a positive thing especially to those who are nervous of claiming, and will encourage those with lesser amounts to claim to go ahead and do it. I know I'd have no problems writing a letter or two to obtain my money back, but the word COURT terrifies me, as I'm sure it does many. But thankfully Lloyds appear not to be letting it get quite that far. I just think that if it werent for martin and this site, i never would have known i could do this, it's money i wasnt expecting, so that's a good thing.

    Absolutely, I'm glad youre getting your money back from Lloyds, but if you had filed with moneyclaim you would have got your £30 back, so you wouldnt have lost out.

    Thank you for getting in touch with us. I am sorry you are unhappy about your account charges.

    Like any business, we do make a charge for some of our extra services. When customers don't have enough in their accounts to cover a payment, this always means extra work - and it has to happen very quickly. We have to agree to make the payment by setting up or increasing an overdraft, or tell customers we can't agree it. We feel it's fair to charge for this service.

    Of course it's only fair too, that we're completely open about any charged-for-services before you take them up. That's why we take care to give every new customer the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, through our helpline and on our website.

    Just as importantly, we do everything we can to help our customers avoid these charges altogether. I'm sure you'll know how easy it is to keep a running check on how much is in your account. You're free to get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we've agreed, you're welcome to see it if we raise it - and we can usually give you an answer straight away again. Again we can do that for you by phone, on line or at any of our branches.

    I do hope you can see that we make our charging system as fair as possible - and that's why i can't agree to cancel your charges.

    Please let me know if there is anything else I can do. If we cannot come to an agreed soultion after thisI will hekp you refer your complaint to the financial ombudsman service for independent advice.

    If you are happy with the way I have dealt with your complaint, there is no need to reply to my letter. If I have not heard back from you by the 6/4/2007, i will close my file, though I will be happy to reopen it should you wish to come back at any point afterwards.

    Please be aware of what you have posted, they are not saying they will offer £750 but that the maximum they are authorised to offer is £750. This does not mean that a claim of £750 will attract an offer of £750.

    I assume you have been offered £750 as your claim is over £1,000 but thats not to say that someone claiming £750 will get a similar offer.

    Edited to add, if you're happy with the offer thats good, and your attitude is correct its money in your hand now :)

    Any offer the bank makes to you will be in full and final settlement of your claim. They normally send you a form to sign stating you accept on these terms. This means you cannot reopen your claim in the future and claim the rest of the money if you settle for a lower amount.
