Hi all, I did not add the interest to my claim in my 1st letter (which I sent yesterday). If they stall me, like they seem to be doing to everyone, and the 14 days is up and I send my 2nd letter, can I then add the interest to this? Just dont want to do something that later on may come and bite me in the !!! in court!! Thanks

apparently you can only expect to get the interest if you get as far as the court stage anyway...i'm sure you can still have the interest included in the
2nd letter, the template for this letter is just under the calculator in step 4 of martins article (this is what i was looking for yesturday)....if i'm wrong i'm sure some will correct me you have still got 14 days til you send the 2nd letter unless you get a unsatisfactory reply in the mean time

i Have had a reply from lloyds tsb, saying that there charges are fair and how they cannot refund my charges totalling £1450. I then responded to them using the template letter and giving them 7 days to respond. They never responded so i called them a very unhappy grumpy operator advised me that they had recd my letter but will take 4-6 weeks for it to be looked at.
I am just wondering whether to take it to the next step and look at court action, but can they get round this by saying that they have advsied me it may take 4-6 weeks to sort out?
Anyone help?

stick to your own time plan. as long as you stated in your letter that they had so and so amount of time you should stick to it.
they can charge you £30 or so within days of going over your overdraft, so they can get someone to deal with you know.
only the govt can get away with saying they need 4 - 6 weeks.:A Boots Tart :A0 -
Here Here!! I think as long as you've made yourself clear in writing then you should let them do the chasing. You must, of course follow through i.e if you threaten court by a certain time then actually do if an apprpriate response isn't received by then.0

I'm totally new to this, I've got a total of £1560 in bank charges which relate to penalties but can I claim overdraft interest fees as well? these are the standard fees of about £13 per month.

You can only claim the penalties that you have been charged. Not the interest that has been charged.0 -
Send of your 2nd letter for a reply within 7 days.

I hear the banks are going to the European court in March to fight their case of bank charges being lawful.
If the banks win this will enivatably become fair practice and lawful.
Now my question is if a claim has been made for charges prior to this, do you think the banks will pay up under the old law (Assuming they win) as this was the law at the time of the claim?
I have submitted my 1st letter on the 8th Feb requesting my charges be refunded. Wish me rapid luck!
Also some advice to others, if you have an online a/c you can check your statements for charges as far back as Jul/Aug 2002. If your sending off for statements via the bank which could take up to 40 Days dont waste time. The best, easiest and quickest solution is to apply to have your current a/c online active which should take about 7 Days. The only downside is you cant check a full 6 yrs but 5 yrs aint bad! You can then manually sift through your charges which is easy enough as it clearly states CHARGE
