I recieved a letter from lloyds tsb returning my £30 they charged me for being overdrawn for 9hrs. I received this after 3 phone calls and the 1st template letter i sent. I know it's only a small amount but I'm very pleased. Thank you martin and fellow money savers for all your brilliant advice.HOW MUCH ?0

The bank was Lloyds TSB and we got the standard replies (they ARE lawful etc). When my friend realised she would have to pay £120 to go through the small claims court we decided to go to the ombusman since it was free.
Filled in the form, sent it off. Took about a month but Lloyds have finally backed down and offered a full refund of all the bank charges - no interest though.
So if you are concerned about forking out for court fees, or are concerned about going through the court system, this is an alternative.
Thats very useful to know that you can go through the ombudsman as opposed to paying to go through the court.
Is the threat of the ombudsman as effective as small claims court all the time though??0 -

Helpful post, but interest is a key factor in claims, just as it has been when Banks have stoked their charges onto your account balance, and many people will not be liable for Court fees, those in receipt of Benefit, for example.
I just feel this aspect should be emphasised.

Please help, I have already written to Lloyds TSB with the initial letter, they have subsequently written back to me to say all my charges are lawful, I am now sending the 2nd letter which gives them 7 days before I take it to court, after that then it will be the court procedure, 1st question is which court wd it be a magistrates court, county court or what, the other thing was is there any other way that I could go thru the courts but not have to pay the £120.00, as I do not have the available funds.
Many thanks:janieleeparker:0 -
It will be your nearest County Court. Not sure about the payment bit, are you on benefits? You can pay by credit card if you are able to.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

Thanks for your reply, I am not on benefits, but I have subsequently found out you could go thru the ombudsman with the complaint and its free0

I wrote my first letter to lloyds in January claiming back £1140 of charges. I received the usual "but our charges are fair" blah blah letter back, seven days later. So I proceeded to stage two. Today is fourteen days since they received letter two and being the impatient lady I am, i wanted to see if they had any plans yet on what they are going to do, before submitting my moneyclaim stuff. Spoke to a really nice guy at LLoyds (really nice - rare!) who was clearly well up on the issue. He told me that Lloyds are currently snowed under with these letters but that they are in the process of offering "goodwill" (nb not a refund) payments to people. But that the maximum they can offer under the goodwill scheme is £750. he also said that they will be offering this without asking people to sign to say they wont pursue the rest. Which I think is good news really! He asked me to wait seven days for the letter of offer, which I intend to do as I dont want to pay moneyclaim too hastily. So if your trying to claim less than £750 chances are they will pay up at the letters stage. Yipee! and then you can hit them for the rest.0

Why dont you want to file the moneyclaim? I sent the first letter to Lloyds and got the standard response, sent the second letter giving 7 days. They didnt reply so I did the MCOL thing. Its now a week since I did that and they still havent responded. At this stage I'm expecting what I'm claiming for plus interest and charges, I'm not really interested in a good will payment of £750 when I'm claiming £1220 including interest.“A budget is telling your money where to go instead of wondering where it went.” - Dave Ramsey0

Hi, I'm just starting out down this route. I've written to LTSB requesting details of charges, once to head office and once to the data protection address on the main site, as follows
Penny Berryman
Senior Manager
Data Protection Dept.
Lloyds TSB Bank PLC
The Pentagon
48, Chiswell Street
London
EC1Y 4XX
on both occasions including £10 cheque. neither has been cashed and the second letter sent recorded delivery doesn't appear to have been signed for.
Is this the standard delaying tactic and what can I do if they wont even send my info through?
Thanks Clay0 -

I got over £1500 back on behalf of my boyfriend from LTSB. It took about 7 months, so you need plenty of patience!
I agree with Rex, join the CAG website, it's brill!

Hi Helen,
Have tried to get on the CAG website, but can not find it, could you give me the web address ?
Thanks0
