    HIya,
    I rang the court while I was waiting for my court date just to ask them how things were progressing and they really put my mind at ease, but it took me ages.

    I waited about 2 months to get my court date and it turns out it isn't untill 30th October! I started this process in FEb 07 - has anybody else found it's taking this long?

    I have incurred another couple of hundred quid since feb so can i add that onto the charges - i am thinking it might encourage hsbc to make an offer.

    So, basically I have my court date - didn't have to fill out an AQ questionnaire and they've got it in (coincidental I must say) before I go away travelling on the 27th August.

    I know 'when' I win on 24th that the money won't get to me instantly - if it gets that far of course - sorting out letters etc is simple when away as can type them up and get family/friends to send for me when chasing the funds.

    The last line concerns me a bit though - what's the chances of them moving to another Judge/Court? Will scour now for similar but any help would DEFINITELY be welcomed...

    My money just suddenly appeared in my bank account ten days before I was due in court, hopefully you will have the same luck... I'll keep my fingers crossed.

    They still not paid you Kez?
    My case took 5 months in all, I got so frustrated when so many that started after me got paid.
    Don't give up.... all good things come to those that wait.

    I'm getting like that Sandra !! Noooo i'm not giving up, I posted my requests for judgements yesterday to the courts as Lloyds have completely ignored the strike out the judge ordered on the defence on 19th June :rolleyes: The courts are 2 days behind with judgements at the moment so hopefully I'll have it on tues/weds. Woooooo god knows how long it'll take them to pay me once i've got it :o

    I wonder if anyone can help me? Today i have recieved the famous letter offering me £750 as a goodwill gesture. Now my question is very simailar to johnynonails but i carnt find a answer to the question. I am claiming for £2140 or £2336.43 with interest, so if i fill out my mcol do i just knock the £750 of the £2336.43 or what? Sorry i just don't understand how this bit works.

    Just a quick random question for any of you that have won by default and requested judgement. How long after you have won judgement do they pay you ? I can just see this going on forever and im soooo impatient :rotfl:

    I'm claiming my charges back from LloydsTSB for just over £5000(3000 in one account and 2000 in another), they have just offered me £750, which was yesterday, and today before I have had chance to do anything, they have put the money in my account. As you might expect I'm not happy,
    what do you think I should do next?

    Write back to them and tell them you are accepting this as 'part payment' to your claim and without prejudice and you will be claiming the remainder of the money owed to you through the court, this is Lloyds standard gesture of goodwill payment some get.

    I would get your claims filed at court or through the ombudsman whichever route you are taking :D

    The answer to that one is.... They don't pay you. I have posted previously about the status of our claim. Won judgement by default on 30/05. Wrote to them requesting payment by 15th june and phoned SC&M who said that they were going to have the judgement set aside. (We had obviosuly slipped under their radar as far as defending the claim). We threatened bailiff action and have issued a warrant for bailiffs to collect the money. Yesterday received a transfer of proceedings letter from Northampton court as this has been transferreed to our local court cos SC&M are LYING in stating that they never received the original claim so can it be reserved to them.
    I have wrtitten to the Court Manager advising that I want their request to set aside struck out and given a number of reasons why, including a reason to every single one of the points they raised on their request (ie. not having the account numbers, details of the charges etc). I am fuming with LLoyds for this tactic and abuse of the court process. This is a nice little tactic for LLoyds to start the whole of our process again. id. Claim gets served they wait two weeks then put in a defence we wait months for a court date etc etc. So don't bank on getting your money without the need for bailiff action. I don't know what we are going to instruct the bailiffs to do yet. I s'pose he may still visit them regardless evern though this request to set judgement aside is pending.
