Claim gets served they wait two weeks then put in a defence we wait months for a court date etc etc. So don't bank on getting your money without the need for bailiff action. I don't know what we are going to instruct the bailiffs to do yet. I s'pose he may still visit them regardless evern though this request to set judgement aside is pending.
Thanks, well i'll let you know how I get onIm in a little different position, they defended my claim and the judge struck out the defence which Lloyds had time to object to but didnt hence the court allowing me to request judgement. SCAM are VERY aware of my 2 claims as I must of rang them near 30 times to bug them :rotfl:

Thanks Kez. Yes I was aware of your claims, I have been following them with interest. In all honesty in your case I would write to SC&M advising you want payment by such & such a date (you may have already done this). On that day or the day after phone them to ask why they have chosen not to settle (if they haven't by then), and at that point advise that you now have no option but to issue a warrant to recover your money. If they say "go ahead" then do it. I know that once the warrant is issued, the Bank have 15 days to respond/pay up. If they don't then the bailiff will make a visit to the address you entered on the warrant form. Then you will jsut need to keep in touch with the bailiffs for progress updates whilst at the smae time checking your bank account to see if the money has been deposited0 -

No I can't see that they would be able to -seeing as they've already entered a defence which has been rejected. In your case, a judge has made his decision and so I'd imagine that their only course of action could be to appeal against your win - but they won't do that. Far too costly and that would be the type of scenario they are all trying to avoid - in that they would then have to have a full blown court case, outlining their appeal and providing the transparency to their charges structure. They have only been able to get away with requesting our judgement be set aside, because it has never been in front of a judge. They can of course blatantly lie (which they have done) about having ever received the claim in the first place (although the fact that our claim was never returned as UNDELIVERED back to Northampton Court should ring some alarm bells).
The problem you may encounter is just the one whereby you now need to get paid somehow. try nicey nicey, then give up and try the enforcement route. SC&M are arrogant enough, and have enough contempt for the claimants & the court process to completely ignore the judges decision that you win, they lose and therefore they need to pay you. Keep us posted.
Like I've said before, the only enjoyment I'm getting amidst all this frustration and stress is teh fact that SC&M in their idiocy are just arming thousands of people with the legal know how to be able to continually sue LLoyds - not just for bank charges but for all sorts of other issues.0 -

I wonder if anyone can help me? Today i have recieved the famous letter offering me £750 as a goodwill gesture. Now my question is very simailar to johnynonails but i carnt find a answer to the question. I am claiming for £2140 or £2336.43 with interest, so if i fill out my mcol do i just knock the £750 of the £2336.43 or what? Sorry i just don't understand how this bit works.

After going through the long winded process of re-claiming charges, I received an offer this morning for the full amount I was claiming, plus interest and £80 court fee.
Just wanted to say it is worth going through this process even though it seems like you are getting no where sometimes!0
