This is soooo heartening to hear. I lost my father 2 days before Christmas, unknown to me he had been living in extreme poverty and the silly git never asked for help at all. On clearing up his effects my brother and I found, carefully filed away, all his bank statements for the previous two years - we were horrified to find out that Lloyds TSB had been charging him up to £90 a time for going over drawn, this is for a man who had banked with the same branch for 55 years.

Bless him, 6 months before he died Dad took out a Lloyds loan (with insurance) paid it for one month, then took advantage of a 6 month repayment holiday. He died one month before having to start repayments again. The one and only time he actually got one over the b*****ds.

As executors for his estate my bro and I are trying to reclaim about £2800 as an estimate of the previous six years charges. I don't know if we will have any luck but it might pay off the funeral bill.

As it is our inheritance was a single £5 note adn £2.76 in loose change. Both of us now have a framed half a note as a reminder!

Lloyds have fobbed me off with two standard - of the 'we have recieved your complaint and will be in touch soon' type, so yesterday I went to the Money Claim online site and started proceedings as I am sick to the back teeth. As far as I am concerned it is worth the £120 court fee as a gamble.

It is so good to hear that others are getting the money that was wrongfully taken - I am so pleased for you.:T

I havent received a response do i register with MCOL and how much does it cost (i am claiming 675 including interest) and do i send a letter to ltsb sayin i done this?

I think in your case £30 and you should really submit an LBA before you do this

If you actually manage to reclaim any charges then I think his debt will be settled first before you even get anything..

You will have to pay £80, and no, you do not need to send a letter to Lloyds, they will know soon enough when the court informs them. Here is the link to court costs: http://www.hmcourts-service.gov.uk/infoabout/fees/county.htm

Letter Before Action. It is the template for the "give me the money back or I will go to court" letter.
