    HAd 2 letters from solictors both dated same day, one saying they intend to defend the other offering full amount.

    Ok received response from LTSB: regarding my initial claim for refunding charges with interest(preliminary letter)_. there is NO mention of my claim against them in their response, however they have suggested that my complaint is about cancelling my charges.(which it definitely is not) is this legaleese for 'refund my charges' ? if so they have refused point blank. Where do i go from here is , is it a bit early for the LBA?

    I had the same deal, it seams £750 is their standard offer. I paid my court cost, got my court date and yesterday got an offer of the full amount including court costs, interest and the amount to pay into my bank will be full amount less £what they have already paid me. Don't let them scare you.

    I'm bleeding sick of Lloyds now. My claim was defended, the defence then struck out by the judge on 19th June deadline being tuesday past (3rd July) they've got intention of settling with me so I've sent my judgement forms into the court - posted today. See if I get anywhere now :rolleyes:

    Only paid my court transfer fees on Monday, court date was to be 14th Sept bank settleing out of court for £3500+

    I sent off you letter claiming back my charges with interest and they sent a letter back yesterday basically saying tuff luck but if i wanted to complain further i should go to the finacial ombusman. They will deal with your case and contact Lloyds for you. My boyfriend did and he managed to get back £4300 from halifax

    There is news as yet not on the newswire ie bbc, and sky that the lloyd tsb service argument has been won by a claimant in court. If lloyds rely on the barwick case, i am sure that they may not do so once the full details emerge. I have caught news of the win on Penalty Charges site BUT the news mediums do not seem to have picked up on it. When they do then you can breathe a sigh of relief as judges should no longer use the Berwick case as a stick to beat claimants round with. Thought i would share some positive news to all LloydTsb claimants.

    Could someone please give me some advise/assurance.
    I'm sure this has been asked lots of times but it can be a bit of a task ploughing through all the back pages.
    Anyway some background:
    I started this back in January 07 for both my accounts claiming around £6,700, after following all the stages and having received a £750 gesture of good will I arrived at the court stages.
    I filled last week and today I have received a letter from the solicitors (Sechiari, Clark & Mitchell) representing Lloyds TSB stating that the bank will be defending these proceedings. the solicitors then give their reasons on the following grounds.1. the fees that you seek are properly incorporated into your contract with the bank; and2. by making payments from your account where you have insufficient funds to cover them, you are making a request to the bank for an increased overdraft, which the bank may meet or decline. if it meets your request, you must pay the necessary charges. the issue of penalties only arises as a matter of law, where there has been a breach of contract, and there is no breach of contract here.the letter then goes on to say " looking ahead, a situation which gives rise to a dispute is not one the bank wishes to continue. in view of this, you are requested, please, to make contact within the next 14 days with your local Lioyds TSB Branch Manager, to review your account".
    Has anyone else had this letter and has anyone got any surggestions as to what to do about it?
