    ^^ yes got that today but as someone said that i should just say yes to a 750 without prejudice but then start court or FO.

    Another just said the paid for court and got a full offer

    i'm only torn between going with FO or just going striaght to court

    Good thing is if you go with FO and don't get what you want then you can still go to court but if you go to court and don't win you cna't then go to FO

    I got exactly the same letter yesterday. I am wondering if it is another tactic to halt people in their proceedings - some people who are in financial trouble may not want to have a review? Anyway, my account is now 100% fine, so I phoned my bank manager yesterday. He had no idea why SC&M had written this letter, and said they had no 'directives' from head office, so he phoned them this morning to find out. He phoned me back to re-iterate that they wanted to try to help ensure charges weren't received in the future. He agreed (and told SC&M) that I don't need to have a review. I wrote to SC&M confirming that I have spoken to him anyway.

    Hey all,

    I have received a letter from Romford County Court which says;

    "TAKE NOTICE that the hearing will take place on

    24th August 2007 at 2:00pm

    at Romford County Court _______ (address)

    When you should attend

    10 MINUTES has been allowed for the hearing.

    Please Note: This case may be released to another Judge, possibly at another Court."

    So, basically I have my court date - didn't have to fill out an AQ questionnaire and they've got it in (coincidental I must say) before I go away travelling on the 27th August.

    I know 'when' I win on 24th that the money won't get to me instantly - if it gets that far of course - sorting out letters etc is simple when away as can type them up and get family/friends to send for me when chasing the funds.

    The last line concerns me a bit though - what's the chances of them moving to another Judge/Court? Will scour now for similar but any help would DEFINITELY be welcomed...

  • Well seems ignorant Lloyds didn't respond to the striking out of the defence from the judge issued on 19th June or make any contact to settle with me I have now requested judgement from the courts, see how far I get with this :rolleyes:

    Well I am fuming too.
    Today received another stupid letter from Andover stating that as we have isseud a court claim (yes we did back in April) there is nothing further they can do as it's in hand their solicitors (yes we know that).
    Have received a Notice of transfer from Northampton Court (MCOL) stating that Lloyds have put in an application to set judgement aside (judegement by efrault was entered on on 30th May and they never paid by the requeted date of 16th june). We have already issued a bailiffs warrant - and my partner is calling the bailiffs today for an update as the warrant would have been served two weeks ago and I think the bailiffs are due to visit the branch today.
    Lloyds are claiming thet they want the judgement set aside as they never received the oiginal claim and so never had time to file a defence. Also that two of the accounts are closed and that they require details of all the charges relating to the claim.
    What a DESPICABLE stalling tactic. So they want the judgement set aside so as I suppose the claim is then served on them again, they can enter a flaming defence and buy time before any hearing that they won't show up to and will no doubt settle beforehand. I imagine that this buys them months and months. I am livid. I am going to write to the court asking that they strike out this set aside, as we have: given them plenty of time, have written to and spoken to the Solicitors on some occasions, and I have also already fraxed the list of charges to SC&M. I'll keep you posted as this is a total total abuse of the court process - which is publicly funded and on top of everything I still would require our £55 warrant fee back now too.
    Has this happened to anyone else who has got as far as bailiffs.:mad:

    Just wanted to post our success story:
    Our first contact made with Lloyds Tsb was made in February and we have just received the full £1700 we asked for + court costs back from the bank in July. It does take a long time and after lots of letters from the bank stating that they are going to defend and that we are in the wrong, we got there in the end, it was definately worth persuing.

    There were times when the letters made us worry that we were going to end up losing money but as Martin states, 'carry on regardless'. A big thanks to Moneysaving expert.

    I claimed for charges on 2 Lloyds accounts - and recieved their standard reply yesterday and another today.....so i have typed up my second letter - although i was wandering.....orginal letter?? we sent them one along the same lines detailing all charges and requesting they repaid them as they were unfair - back in 2003! got the standard letter then! should i refer to this in my second letter???

    also detailed list of charges - is dates and amounts suffiecient or do we need to list returned cheque, charge etc?
