    I am going round in circles trying to get, at the very least, a copy of the T&C for a current account. OH went into bank this morning with a letter from son requesting a copy of contract and also a copy of T&C for a classic current account. Girl said she would have to speak to her manager and gave OH an application form to open a current account - NO terms and conditions. She told him T&C can be downloaded on the internet. He came home. I tried to find the T&C on internet. Apparantly you have to apply before you can see T&C, so I did and got 'Your Personal Data and Lloyds TSB'. OH went back into bank and again requested T&C. Manager eventually came down and telephoned me (I have authorisation on my son's account). He gave me a right dressing down. I posted earlier about that. He also said that contracts are destroyed after 6 years and point blank refused my request for T&C's. I asked him if I was coming in to open a bank account are you telling me that I cannot get a copy of the T&C before I make an application? There are a lot of current accounts was his response. Yes, I know, I want the T&C of a basic, current account, that my son holds. OH came away with another booklet, nothing to do with T&C at all. He was so rude. My husband was in his office as he was on the phone to me and he told him that he wasn't asking him to admit that LTSB are in the wrong or anything. All we wanted were copies of the contract and T&C's. Not an unreasonable request.

    So in a nutshell, Lloyds TSB destroy all copies of contracts if they are more than 6 years old and you cannot see Terms and Conditions until you apply to open a bank account. Anyone else know that ?

    I am claiming from Lloyds TSB and at no time have I been asked for T&C's. I wouldn't bother with these unless you have been asked to get them by the court. I haven't read of one single person who has been asked about these so don't worry about them.

  • Hi - another first timer here

    Sent off my first approach last week and got a (quick) reply today, rejecting my claim for £820 including interest, on the grounds that the charges are fair.

    Onto the next stage it is, but one sentence in the standard reply got my goat and I wonder if I should address it in my follow up letter.

    The letter says "we do everything we can to help our customers avoid these charges altogether"

    That's as may be (yeah right!) but on at least one occasion that I identified in my statement trawl, they have continued to honour my use of my cashcard in shops etc (not ATM withdrawals), and then stiffed me for going over my limit and beyond. Should I raise this point?

    Thanks for all the advice so far - will keep you posted how I get on.
  • Once you have sent the first letter requesting statements, do they in some cases pay up after that or do they give an answer. Do they send you all statements going back 6 years.

  • i know its not much help, but all of those options can and have happened. A common response is a request for £10 to process the list of charges, which you should pay. Then see what happens

  • Thanks. I am thinking about sending a letter to TSB. I paid my overdraft of a couple of wks ago so I can hopefully get shot of them.

    You need to send the letter asking for the information/statements with the £10 cheque to pay for this and then once you have worked out what charges you are reclaiming you then need to write the first letter asking for the return of your charges. Follow the step by step guide...

    anyone know what im supposed to do as just recieved an order from court saying the stay is extended to 31st jan for the oppertunity to negotiate a settlement and if neither party contacts court by 14th feb it will be struck out !!! do i write to S & C and ask them to settle and what if they dont respond
    it cant be struck out as its been 4-5 months and a lot of hard work to get this far

    i really dont know whats expected of me now
    i really nrrd someone to talk me through the next step please

    Because of the tight deadline you have. Send a recorded/registered delivery letter giving them 7 days to settle the case. If they don't reply or don't offer a decent amount, write to the court straight after the 7 days with a copy of the letter, telling them what response you had/didn't have. Tell the court you have made every reasonable effort to settle (including giving them time before you issued the court claim, and going to court was a last resort).
