    Hope I`m not going off subject, but completly new to this forum and do not want to stop or delay the thread, but not sure about starting new one, just seen that Kathy was discussing LTSB so joined in. I am considering the reclaiim process and have been charged varying amounts on unauthorised borrowing on my business overdraft, but since the 3/3/03 I have had 119 £10.00 charges for unauthorised borrowings, are all of these reclaimable or should we claim £4.50 each time on our initial letter?
    Does the process allow for business accounts?
    Or do I just go for Gold and see what happens?

    I thought if you wanted the t&cs you can get this by paying the £1 and asking for your signed copy which they legally have to do within 12 days

    I am also claiming charges added to our business account. I am totalling up all the charges for unauthorised overdraft, returned cheques and direct debits etc., in total. From what I have read, I think there might be some differences if you are a limited company, otherwise it's the same procedure as for personal accounts until you get to the court stage when you need to fill in your "Particulars of Claim" slightly differently. If you go onto https://www.consumeractiongroup.co.uk, there is a lot of help available including template letters. You just have to register, which is free.

    Am i being really stupid because i was fairly certain that you don't need the terms and conditions because no matter what it says in the terms and conditins what they are doing is still unlawful. If you read the FAQ someone else has asked "isn't it in the tems and conditions?" to which he answered "if someone says they are going to punch you and then they do, doesn't make it legal". Type in bank charges on the search bar and it should take you to that page.
  • That's what I thought. It doesn't seem to come up anywhere as a requirement at court stage. Any ideas anyone? :confused:

    See post #4 in THIS THREAD for a list of charges you can reclaim. You claim for the whole amount of the charge, you don't deduct anything from it.

    over the last 6 years ive paid a fortune to LLoyds TSB in charges, however most of these are for bounced direct debits (£35.00 a time) and also for letters telling me im over drawing £35.00 i think they are. I dont have an overdraft but they were allowing me to go oeverdrawing and charging me for sending the letter out.

    i'd say over the 6 years ive paid well over £3000 in charges - can you claim for these sort (because in theory it was my fault the direct debits bounced by not having the money in)

    just want to know before ringing TSB to ask for a copy of my last 6 years charges

    of course you can look through the forums tells you everything you need to know worse that can happen is they refund all the charges and close your account
