I am in exactly the same position as you, but have phoned scam, they weren't interested at all. All they would say that they are waiting for direction from their client. I'm getting really fed up with all of this - it's one battle after another. I have another claim with Lloyds which I haven't been able to afford to put it through the courts and Lloyds are refusing to even look at it untill the other one is settled. I've just complained to the banking ombudsman, copied the complaint to Andover, made a complaint on BBC's watchdog and copied the whole lot to Lloyds PR Dept, lets see if I get a response now?????

I'm just waiting for my court date, have you had yours? Go and have a look a the CAG website, they have a whole thread on court bundles and templates. Still no news from Lloyds and FO says it can take up to 8 weeks to look in to my complaint..........best not pack my bikini just yet!!

I am so in the same position as you and now hace 28 days to file my court bundle. I do not know ehere to start and to make matters worse, this was a joiny account but I only put my name on the court papers and did not put the acc# on it!!! Oh God.
I have 3 other accounts and as I can not afford to pay the cout fees, I have sent all the paperwork to the FOS asking them to look into the refunds on my accounts.
I have had enough now and wish I hadn't started the Court action as it if for £288.00.
Please please please, can anybody loet me know what I need to do prepare my Court Bundle and will it being a joint account make a difference as only my name is on the Court paperwork.

I am doing the process on behalf of my son and husband, they have both just received a letter from Lloyds TSB in reply to letter 3 sent at the beginning of May, 'requesting refund or take to court'.
It contained a leaflet 'Your complaint and the Ombudsman' and an apology for taking so long. saying 'Please bear with us so that we may try to reach an amicable conclusion. I will continue to monitor the progress of your complaint and would liek to take this chance to thank you for your continued patience'.
What do I do now - do I send the next letter or wait another couple of weeks. or contact the ombudsman.
Also if we do the next letter (letter 5) can I change the time given them from 14 days to say 28 days. Im not confident about doing all of this and would prefer the longer time scale.

If the last letter you sent them was the letter before action (LBA) then yes nows the time to file your claim,

Amount claimed: £2963 INC INTEREST AND COURT FEES
Amount received: £3094.50
I sent the original letter on 17/4/2007 asking for my bank charges to be repaid. I received the usual reply, that they are looking into our complaint. After 14 days I sent the 2nd letter, still no offer of payment, so filed MCOL on 6/5/2007, which was defended by Lloyds. I received a notice the defence was to be struck out by Boston County Court on 19/6/207they had until 3/7/2007 to object. I rang SCAM daily and was told on thursday that a settlement offer had been sent out to me offering the full amount which I have received this morning. :j :j :jMember & fundraiser for Meningitis Research Foundation0 -

SCAM is the intitals of Lloyds TSB's Solicitors
I can't remember their names but the initials are
SC And M, so if you use the A from And it spells SCAM.

Johnbfan - as no one has posted a reply to your post, I will.
The letters that you are recieiving from Lloyds are fob off letters that we have all received in one form or another. Some say go away you're not getting your money, others say we are still dealing please give us more time to investigate etc etc - so the fact that you have a different response for your husbands account from that of your son's is nothing unusual. no doubt they are signed by different people at Andover Recovery Centre - Kerry parfitt, Debbie Gilbert & Martin someone or other are three of the people that we have received different responses from.
Basically you are going to get nowhere just leaving them to plod along, therefore you should now be looking at starting a court claim against them. Therefore you will need to persuade yourself that you have given them enough time already to deal and go for it. Start a claim for each of the accounts on the MoneyClaim online Website (It will cost you £120 per claim) but you will get this back when you win your settlement. HOWEVER, if you so desire - you can take your complaint to the Financial Ombudsman (as per the leaflet that LLoyds have sent you) and they will take up the case for you free of charge. Myself & many others have gone via the Court route, but reading through previous threads many people have taken the FOS route and been successful too - It may even be a quicker route to getting your money, and is certainly cheaper in the short term if you don't have the £120 available for each Court claim. Either way, and whatever you decide, do not leave it any longer. I started my claim whilst LLoyds were still begging via their letters for more tiem - as I knew that they'd send me another letter begging for even more time - which true to form they did. Too late by then I'd started the MCOL claim having decided to waste no more time.
I'm not there yet however. in their arrogance SC&M & Lloyds have not paid us/settled/written to us - even though we have issued a warrant and the bailiffs are visiting the local branch this week. Hope this helps0 -
:mad: I feel like taking a day off and going to Andover and speaking to them face to face. Having now written to them twice asking for my charges back (1st letter was 38 days ago), and left numerous messages on the Andover voicemails, I now find that every number has a full voicemail so you cannot leave any details. I found a geographic number for Lloyds and rang them and the lady very kindly gave me a freephone number (0800 389 8766), which eventually puts you round in a complete circle and you get an adviser that says he has been told to tell people to wait for 2 months for a response to any letter. He was very "whatever" about it.
Their deadline is up tomorrow so I'll just go ahead and take them to court and that way I might get a response!!In spite of the cost of living, it’s still popular :eek:0
