excellent news! i've had an offer today aswell! do we have to make a copy of the letter and send the copy bk to the solicitors or can we just cut the reply bit off?0 -

The copy letter the solicitors want is a copy of your letter to the courts (once the bank have paid you the settlement amount) to stop the court action. This is so they know you have done it and they can close their file.0 -

Don't mess about with them either start a court action or go through the financial ombudsman.
Make sure you call the shots not the bank.0 -

Had first letter back from them after only a week
blah blah sorry you feel this way.
we expect our enquiries to be completed in 4 weeks, and will let you know if there is a delay and why and when you will expect a full response.
Can i ask your help? Do i sit back and wait (bank taking charge again) or do i send a letter if so then what letter

Send letter back stating:-
I am writing to advise that I have taken your points into consideration and unless this matter is resolved to my satisfaction (XXXX (name of bank or other) refunds the full amount of the default charges namely ??? (amount of default charges) plus interest of ??? making a total of ????) by XXXX(14 days from the date of the letter you are sending) at the latest, it is my intention to claim the full amount claimed together with interest up to the date of judgement and court fees in proceedings through the County Court.
This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not porportionate to your costs, and therefore the County Court will rule in my favour.
I look forward to a full response to this letter by no later than XXXX (14 days from the date of the letter you are sending), otherwise I will commence court proceedings to reclaim my money.

I am in exactly the same position as you, but have phoned scam, they weren't interested at all. All they would say that they are waiting for direction from their client. I'm getting really fed up with all of this - it's one battle after another. I have another claim with Lloyds which I haven't been able to afford to put it through the courts and Lloyds are refusing to even look at it untill the other one is settled. I've just complained to the banking ombudsman, copied the complaint to Andover, made a complaint on BBC's watchdog and copied the whole lot to Lloyds PR Dept, lets see if I get a response now?????

HI Mel,
I am so in the same position as you and now hace 28 days to file my court bundle. I do not know ehere to start and to make matters worse, this was a joiny account but I only put my name on the court papers and did not put the acc# on it!!! Oh God.
I have 3 other accounts and as I can not afford to pay the cout fees, I have sent all the paperwork to the FOS asking them to look into the refunds on my accounts.
I have had enough now and wish I hadn't started the Court action as it if for £288.00.
Please please please, can anybody loet me know what I need to do prepare my Court Bundle and will it being a joint account make a difference as only my name is on the Court paperwork.

well since the court advised the defence they submitted on me to be struck out in 14 days from 19th June that gives them until tuesday (3rd) still no offer of settlement so looks like they ll be objecting to the strike out and ill be getting a hearing date I presume, :rolleyes: have they done this to anyone else ?

Received a letter yesterday from local court, ORDER AND JUDGEMENT, basically Llloyds havent served and filed their paperwork by the chosen date of 18/6 so the court have extended it and given them til 11/7 if not we win by default and court vacated.
Has this happened to anyone else? what was outcome?
