I am currently trying to claim back my husbands charges from Lloyds - they amount to £4142.30 including interest. Having sent the first letter asking for the money back, we have received a letter saying that..."they are not default charges because you haven't broken your agreement. They are our prices for the service we provide in these situtions". I don't understand this. What are default charges?
The original letter asked for money back for charges such as unpaid DD and overdraft excess charges. I thought you could claim for these. Are they trying to bombard me with information or is the long and short of it that they're not giving the money back???
What do I do now - do I go ahead with the letter threatening court? Which court do I put down?0 -

Having looked through the letters we have sent I realise I have yet to send the letter6. We are a bit at 'sixes and sevens' at the moment due to a close family member being rather ill in hospital, this has meant I have not been able to get my head round this for a while. I will get letter6 off as soon as possible.
I did wonder when I read the leaflet from the Ombudsman if we could go that route instead. Due to my son no longer working and other difficulties here, the Financial Ombudsman may be the better route for us for now, as it would give us more time before we had to go the court route and I realise that if that is not successful then we could then go the court route after. I will now get on with the letters and keep my fingers crossed. Will be back Ive no doubt.

i have been trying to reclaim back £3600 in bank charges since febuary.i have just been sent a goodwill gesture of £750.i have phoned the bank which is lloyds tsb to tell them that i am not happy with their offer. the bank are now sayin i either take them to court or use the financial ombudsman service to deal with my claim.the question i would like to have answered is which way is the best way to go?????????0

Hi today I recieved a letter from my banks solicitors
It says we have been passed a copy of proceedings that you have issued agaisnt our client in x court (this is the wrong court as i have had to get it transfered 4 weeks ago as they moved it 200 miles away from where i live with no explanation) the bank will be defending on the following grounds:
1. the fees that you seek are properly incorporated into your contract with lloyds
2.by making payments (whether by cheque,dd,dc or any other means) from your account where you have insufficient funds means you are making a request for an increased overdraft.You must pay the necessary charges. The issue of penalties only arises as a matter of law, where there is a breach and there is no breach here.
Looking ahead a situation which gives rise to a dispute is not one the Bank wishes to continue. In view of this you are requested to make contact within 14 days with your local lloyds tsb bank manager to review your account. We await confirmation from the bank this action has been taken.
Firstly what the heck does it all mean lol and what do I do?
Do I contact them? My last charge was taken in 2005 so I dont see how changing my account will benefit me now-I did ask them at the time but they refused :mad:

Yes - send a letter now to the Financial ombudsman explaining that you have applied for bank charges, given Lloyds plenty of time to deal, but they have not yet given you a satisfactory conclusion to your issue. This in effect breaks Lloyds own Customer Complaints procedure - as i would imagine that they have 30 days or so to deal with your complaint , which they have not done (with yours or anyone elses complaints). I wouldn't bother sending Lloyds another letter - they are not going to deal with your issue in a timely manner and are in fact encouraging you to proceed via the FOS route (as it costs them less money in the long run, as they don't have to repay your court fees), and as it would be costly for you to issue court claims at a time when it sounds as though you already have enough on your plate, then the FOS option is probably the best; certainly the cheapest (and could even be the quickest route) to a a result. the good thing about taking the FOS route is that if you do not get repayment (which you WILL do so don't worry) you can then still take them to court. If you proceed with the court route then you can no longer approach the FOS for help. Have a read through some of the previous threads OR Lloyds Success stories as there are a number of posts which show successes in fairly quick timescales when people have opted for the FOS route. You have received the standard letter that we have all had, Time to post off letter 2, you don't need to put any court just use the letter template on this site.0 -

Have just had a letter back from Lloyds TSB in reply to claiming back bank charges of over £2000 which they have said they have looked at but are not gonna refund!! am a little bit scared of taking it any further as have current bank account still with them with £1500 overdraft which dont want to have to pay back immediatly if upset them.
Can any one help, anyone claimed back from lloyds tsb succesfully , should i threaten court action!!!!0 -
Thanks Ronnie - I am going to start sorting out doing the FOS stuff. Am going to have to get stuck in next weekend as I am at the hospital every evening as my dad is in at the moment. Working full time doesn't leave much time for this but I will get down to it. Will go on their site and read up as much as I can and get myself prepared.

Having not got anywhere with Lloyds I have now filed 3 complaints with the FSO.

- They way Lloyds are dealing with the complaints about charges
- Lloyds Complaint procedures

Even if you are going down the court route, still complain to the FSO about the way they are dealing with it.

If you complain about the service you are getting, concerning claiming bank charges, the FSO will investigate this and it may make Lloyds pay up quicker to stop it.
