    I have just recieved notice of transfer of proceedings...

    Allocation questionnaire has been dispensed with.

    Tsb have put in a nine point defence.

    No actual court date yet.

    S.C.A.M s name and number is on the document.

    Sit tight or give scam a call?

    Hi all, I promised to update you with my progress with my claim against LTSB and its charges with FOS, so here's my latest update:

    26/06/2007 Complaint form to FOS along with all copies of previous correspondence to LTSB
    03/07/2007 Acknolwledgement from FOS confirming receipt of paperwork.

    I Have a claim that is ongoing with Lloyds TSB, however I have been charged in the last 4 week even more charges, can I start another claim? and if so do I just use the same template letter, and edit it to say the last 4-8 weeks?

    Any comments appriciated.

    Ok, a question for you guys.

    This morning on MCOL my Status has changed to acknowledged and they have 28 days from when the claim was served.

    Does this mean they have filed a defence or still have the extra time to do this and i take it they don't have another full 28 days to respond, they only have the difference between when it was served which was 2 weeks ago which would mean they have another 14 days or so?

    Lloyds defended my claim and the judge decided rather than setting a hearing date he was goin to strike out the defence Lloyds submitted against me on the grounds of abusing the courts system as they usually settle claims before a hearing date is reached hence wating the courts time. They gave 2 weeks from the 19th of June for Lloyds to object which was up yesterday and I haven't heard from the court or reached a settlement from Lloyds yet :rolleyes:

  • Hi, I am new to this and need some help please. I followed all steps on money saving exp and have now put in a claim with Money claim online - I have now had a letter titled ' Notice of Transfer of Proceedings' telling me a defence has been claimed, along with a notice from Northampton Count Court saying 'It is ordered that the filing of an allocation questionnaire be dispenced with in this case unless the Distric Judge at the court of transfer orders otherwise' with a date order drawn date, and a N9B form entitled Defence and Counter claim (specified amount) this tells me to fill it out and send back with in 14 days but I thought it should be a N149 or N150, as it looks like LTSB have filed all this out and not made a counter claim just disputed the full amount and made a 9 point defence. will I get sent the other forms? have they sent me the wrong one? if so should I call the court? or do I need to fill out something on the form to accnowledge it? V. confused can anyone help - tried to look for help on web for N9B but it just keeps showing me a copy of the form i can use and print out! Thank you

    If you haven't filed a court claim yet, there is no need to send them another letter - simply add the new charges when you get around filing the court claim. You can add all charges and interest right up until the minute you file the claim. If you have filed a court claim already, you can add charges for an additional £35.
