    Again, I would advise you to ring the court and ask. They were really helpful to me and are probably used to it. Better to find out than to miss something and blow your chances of winning!!

    Ah, what it was was a spelling mistake on their part! durrr.
    2. Claimant at liberty to reply at least 7 days before the hearing.

    Hi,
    well, lloyds defended my claim so was just waiting for it all to go to the local court. got a letter yesterday:

    Before District Judge Maw sitting at Lincoln County Court
    Upon reading the papers in this matter it is ordered that

    The court, of its own motion, is considering striking out the defence in this action as abuse of process.

    The basis for this is the fact that the Defendant is settling all claims in this nature where Claimants are seeking the reimbursment of bank charges, with no claims proceeding to a contested hearing.

    The court considers the authority of Mullen v Hackney London Borough Council (1997) relevant.

    If the defendant objexts to the proposed strike out, it is ordered to file, by no later than 26th June 07, a schedule setting out all claims of this type in England and Wales which have proceeded to a final contest hearing, and the outcome of such hearings, together with a schedule ofall such claims which it has compromised before the final hearing after proceedings have been issued.

    Upon receipt of such objections, the Court will consider listing the claim for an on notice hearing of the strike out issue.

    In the absence of any such objection being filed in time, the defence herein will be struck out a judgement entrered for the amount claimed by the claimant, together with the appropriate costs claimable on the small claims track.


    so just got to wait and see now, but looks like the courts are starting to fight back, getting fed up of all small claims!

    Oh yeah - had the baby, 9 days late, on 1 June - a baby girl.

    Ahh congratulations honey, I hope you and you daughter are well.
    You need to start to get your court bundle ready, its quite a bit of work. If you need a hand PM me and I'll try and help, I submitted mine yesterday. I know your brain can turn to mush when you have had a baby xxxx

    Thank you - we're both fine, she's a little angel.

    It doesn't look like it'll get as far as court unless lloyds can come up with something good. going to wait until the 26th june and see what the judge says, then go from there.

    This is my first post so I hope I'm doing this right!

    I hope someone could give me bit of guidance regarding my court claim against LloydsTSB. I have gone through all the necessary procedures: requested statements, calculated charges and interest total, sent letter asking for my money back, received standard 'sorry you are unhappy with our service etc etc'. I have now started court action via moneyclaim, so far the bank have acknowledged the claim and they have until monday 18th June 2007 to enter a defence. I have now received a letter from their solicitors saying that I need to send them details of the individual charges with interest calculations and what each charge refers to by the 22 June 2007. I have sent all this info to the bank - do I have to do it all over again?

    Many thanks for any advice - this is a great site and without all the inforamtion posted here I wouldn't have got as far as I have.

    I have already posted this on the sucesses thread, but I am posting it here as well because reading this thread is what has kept us going for the past 4 months. Please don't give up - together we can win against Lloyds TSB !!

    Bank: Lloyds TSB
    Amount Reclaimed: 1063.89
    Amount they paid: 1063.89
    The story:
    We sent the 1st letter on 25th March and waited 4 weeks for the standard letter saying no, our charges are lawful blah blah blah.
    Following Martins advise we sent the 2nd letter on 30th April and gave them 14 days to respond otherwise we would start court proceedings.
    On 24th May got the letter to say 'sorry you are not happy' but we have already outlined our position.
    Started MCOL on 15th May and they acknowledged on the last day
    They had until 18th may to enter a defence and got home tonight and the money was in the bank !!!

    We never thought we would win, I read other sucesses all the time and I never thought I would be writing this.

    Thank you soooooo much Martin, I am off now to pay some bills and treat the children.

    hello there
    hope you can help i am waiting for my court date ? what paper work do you need to put together so i can get a start on it as i am worried that my claim going nowhere lloyds put in defence on the 28th of last month and still nothing help please
