Hi,
S.C.A.M offered to settle in full on the 3rd May..
I signed and sent the letter back on the 10th May by recorded delivery.
Up to this day i have not seen a penny ..everytime i ring them they tell me there's a delay and it won't be long. Today, after 5 weeks, they acutally rang me to tell me that they never received my letter and could i fax it to them so they can put the money in my account. They gave me a fax number which turned out to be non existent, they told me not to use the one on the settlement letter..but i did anyway...i feel like they're really giving me the run around as i don't believe for one minute that they never received my letter and giving me a fax number that doesn't exist is just so childish..
has anyone been in this situation before?? i really don't know what to do next as ringing them is just a waste of time..
thanks xxx0 -

I like their acronym.
At what stage is your court claim? The acquisition of wealth is no longer the driving force in my life.0 -
Their acronym sums them up nicely i think :j
my court date is on the 16th July... but i never received S.C.A.M.S court bundle...
I'm starting to pull my hair out!!:mad:0 -
they coughed up 2500.
took them to court, they filed no defence so court found in my favour last week.
they put 2500 in my account yesterday. no letter, no acknowledgment, nothing.0 -
I started the process in July 2006. Was undecided what to do in October but after reading on https://www.consumeractiongroup.co.uk how the process was going we decided to steam ahead.
Court date: 28th June. Court Bundle was sent to Court and SC&M on Monday. Non compliance letter sent to SC&M on Thursday with a copy to Judge. Son looked at his account late last night. FULL AMOUNT CLAIMED had been deposited in the account yesterday :j :j :j :j . Thirteen days before judgement day! :j :j :j
Many many thanks to MimiJane for her brilliant Index which she sent me as a guideline. :T :T :T :A
So it is now over for us - thankfully.
Don't despair or give up. Be thoroughly prepared to go to Court with all paperwork - we were. That way you will feel far more confident but hopefully like us it won't get that far.
Good Luck to everyone else.0 -
I am ready to send off my first letter to lloydstsb claiming back £2500. however I live in Scotland and the account was opened here.
i've looked at moneyclaim online but this needs an address in england for papers to be served.
is there a way around this?
I've heard that small claims are limited to£750 in scotland. is this true?
if so how do i go about getting my full claim answered?
if not. how exactly do i go about making the claim through the scottish courts?0 -
This morning I have received a copy of the defence Lloyds have submitted to the court against me, it says things like:
By opening an account with the bank the customer enters into a commercial agreement with the bank for the provision of banking services. The bank is entitled as part of the agreement to charge for those services, these details are provided in 'a guide to our banking charges' leaflet.
There is no breach of contract, the charge cannot therefore be a penalty, consequently there is no requirement that the charge be a pre-estimate of the banks loss.
The customer is given advance warning of charges being imposed. statements show the charges, if any, the customer has incurred during the course of a month and which will appear as debits on the following months statement.
The charges are fair and reasonable, and it is denied that they are unlawful.
The bank is entitled by contract to impose the charges, which are fair and reasonable.
It is denied that the charges are unlawful or contravene any statute or regulation.
The claimants claim is denied in its entirety. It is further denied that the claimant is entitled to the sum claimed or any sum from the bank.
Is this a normal Lloyds TSB defence ?

I got £750 goodwill payment off Lloyds the other week, can I now do what I want with that, or as I'm going to claim the rest through court shall I leave it sitting in the account for now? (I could move it to a high interest saor a little while I guess??)0
