Hi honey, my claims have been going since end January!!!
I have written to SCAM many times but I don't think they even bother to open their mail.
My claims are small just over £1000 together, wish me luck my court date is next week :eek:0 -

I have already posted this on the sucesses thread, but I am posting it here as well because reading this thread is what has kept us going for the past 4 months. Please don't give up - together we can win against Lloyds TSB !!

The story:
We sent the 1st letter on 25th March and waited 4 weeks for the standard letter saying no, our charges are lawful blah blah blah.
Following Martins advise we sent the 2nd letter on 30th April and gave them 14 days to respond otherwise we would start court proceedings.
On 24th May got the letter to say 'sorry you are not happy' but we have already outlined our position.
Started MCOL on 15th May and they acknowledged on the last day
They had until 18th may to enter a defence and got home tonight and the money was in the bank !!!
We never thought we would win, I read other sucesses all the time and I never thought I would be writing this.
Thank you soooooo much Martin, I am off now to pay some bills and treat the children.

my partener has the exact same letter, with ltsb defence on too. aint got a clue what all this means an now worried, i not been sent a allocation questionnaire. do you think this means we have lost.......
Many of the courts are doing away with the requirement for the Allocation Questionaire.
Nothing to worry about.

S.C.A.M offered to settle in full on the 3rd May..
I signed and sent the letter back on the 10th May by recorded delivery.
Up to this day i have not seen a penny ..everytime i ring them they tell me there's a delay and it won't be long. Today, after 5 weeks, they acutally rang me to tell me that they never received my letter and could i fax it to them so they can put the money in my account. They gave me a fax number which turned out to be non existent, they told me not to use the one on the settlement letter..but i did anyway...i feel like they're really giving me the run around as i don't believe for one minute that they never received my letter and giving me a fax number that doesn't exist is just so childish..
has anyone been in this situation before?? i really don't know what to do next as ringing them is just a waste of time..

I'm in the same position. Sent my letter accepting full payment back to them on the 7th June. Phoned them a few days ago and they said its taking 3-4 weeks to pay up.
Following your post I sent a faxed copy to the number on their letter head today.

i sent letter 3 to Lloyds TSB, Gresham St by firstclass recorded delivery on 05/06/07 but using the tracking service on royalmail but they cannot track the item. So i sent another letter on the 11/06 and again the item cannot be tracked...
Has anyone else had any problems like this?
Do ignore the fact that the letter might not have been delievered and give them 14days from the 05/06?

I have had problems with Royal Mail recorded delivery also. Can't track first item to this day (2nd letter to TSB), 2nd attempt successfully delivered at the weekend.
I contacted Royal Mail and was told to allow 15 days for delivery. Called again after 15 days and was told that I needed to allow 6 - 8 weeks for delivery as was standard postage! (yeah, right!). Could walk there in that time and post it by hand myself.
Never mind, as resent item has confirmed delivery I now give them 14 days from that date.
I would strongly advise to give them 14 days from the date you can definitely confirm delivery to them. Think of how it would look in court if you couldn't confirm they had received the item.

i have submitted my claim on moneyclaim. i did this on friday.. agianst Lloyds TSB. it now says 'start' under judgement. what do i do next? do i wait till 14 days to see if they defend?
when do i know when the 14 days have started? sorry really new to this. just finding my feet. thank you0 -

you need to wait the 14 days from the date it is assumed to have been served (you'll get a form through the post confirming your claim and giving you the dates). LTSB will probably acknowledge at the last minute thus giving them a further 28 days. Good luck.
