  • Hi, Started Clamining End Of Feb, Posted Off Step 4 About A Month Ago, Still No Reply. Do I Send Off Next Part Of Step 4, Consider To Offer Bank An Option Of Settling?
My Main Concern Is That I Have Moved Banks, And Now Having To Pay Overdraft, Which Is Now Over Due To Charges Being Added, Via A Payment Plan With Cccs, Have Wrote To Bank Asking To Close Account, Which They Have Refused, Without Speaking To Them, Don't Want To Do As They Must Be The Rudest People On This Planet. I Am Really Worried That Part Payment, Which Has Been Paid To A Lot Of People Maybe Swollowed Up, If The Dounuts Offer To Me, Can Anybody Tell Me If You Can Ask For Settlement Via A Cheque? Even If They Pay Into Bank First?

Great Site, I Feel Things Are Slipping Away, As I've Not Heard Anything From The Bank, I Feel Alot Better After Visting And Reading Through.

    Cheers..

    Hi all
I haven't posted for a while as nothing happened but after reading some posts i ought to let you know i started mid Jan with Lloyds , I did everything to time scales, and had my case defended so still waiting on court date , I've had no goodwill gesture, my casw went before the judge for directions on the 25th april so you can imagine how fed up i am waiting, i've phoned the court, their solicitors and even andover numerous times and have been told I will prob be in court in august, I hope i haven't made you all too depressed this morning but i thought as someone who has gone most of the way it would give some of you an incite into the timescales

    Hi Lara,

    Firstly thanks for your reply.

When you say fat chance, I take it to be fat chance it's sorted by end of August rather than fat chance of getting anything back?

I did take note of the 'put it on the AQ form' part - I'll keep looking now but has anyone won when they have not gone to court and the bank not turned up?

Sorry if this has been addressed a million times but there are so many thread and posts it's hard to ask everyone at once! :(

    Cheers again all...

Hi - sorry but I meant fat chance of it being sorted by end of August:eek: . It takes ages for some cases to be given a court date. I have been waiting since late February. Our case is now two weeks away, court bundle been handed in and just a case of waiting now.
There was a case recently where the claimant didn't turn up neither did Lloyds and Lloyds won the case because insufficient evidence was handed in by claimant. So you can't automatically assume you will be given your charges back. You have to work for it  .
If you really don't understand the process I would suggest everyone goes over to the https://www.consumeractiongroup.co.uk and registers on there. You will find templates and whole procedures for taking your claim further. You will need to register but it doesn't cost you anything. They are helping specifically with reclaiming and you may find it easier to go there. You start your own thread and help usually comes along. HTH
  • After reading through some of the more recent threads, I am starting to get a bit worried that this is all in vain.
We have just had the letter back from Llyods stating that the charges are not unlawful and they cannot payback any of the charges, I was just going to send off the next letter threatening court action, but is it worth it?
If so, how long will it all take before I get the money back?
